A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, SUMMARILY VACATING AN EASEMENT
OVER A PORTION OF BLACK RAIL COURT.
WHEREAS, a request has been made to vacate a portion of Black Rail Court, and
WHEREAS, that easement previously dedicated contains no public facilities or
appurtenances, and
WHEREAS, the easement previously dedicated provides no useable access to the adjoining
property, and
WHEREAS, no street improvements have been constructed on the easement previously
dedicated;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct,
2. That, pursuant to Chapter 1050 of the California Street and Highways Code, said
easement, more particularly described in Exhibit A and shown for the sake of clarity on Exhibit B,
be summarily vacated.

3. The City Clerk is authorized to record this resolution concurrently with or after the
recordation of Minor Subdivision No. 834 in the office of the County Recorder of San Diego
County.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held
on the 8th day of May 1990 by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Mamaux and Larson
NOES: None

Being a portion of Black Rail Court as shown and dedicated on
City of Carlsbad Tract 85-35 Phase I-Unit "D",in the City of
Carlsbad, County of San Diego, State of California according
to Map thereof No. 12412, filed in the office of the County
Recorder of San Diego County on June 29, 1989 as file no.
89-346188 being more particularly described as follows:
Beginning at the intersection of the westerly line of lot
229 of said Map No. 12412 and the southerly right of way line
of Black Rail Court as shown and dedicated on said Map No.
12412 said point being on the arc of a 380.00 foot radius
curve concave to the North, a radial line to said point bears
South 02*04'55" East; thence Westerly along the southerly
right of way line of said Black Rail Court and the arc of
said curve through a central angle of 31*10'52" a distance of
206.80 feet, to the beginning of a reverse 90.00 foot radius
curve concave to the South, a radial line to said point bears
North 29'05'57" East; thence Westerly along the arc of said
