RESOLUTION NO 90-133
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARL;
CALIFORNIA, SUMMARILY VACATING AN EASEMENT OVER A PO:
OF EL CAMINO REAL SOUTHERLY OF THE INTERSECTION WITH C1
DRIVE
WHEREAS, a request has been made to vacate a portion
Camino Real southerly of the intersection with Cougar D
and
WHEREAS, the center line of El Camino Real was realign
a position west of the original road alignment and,
WHEREAS, the realignment created a surplus area of r
of-way along the easterly side of El Camino Real in exce
that required pursuant to current or future needs and,
WHEREAS, all public road improvements have been
adjacent to the excess right-of-way in conformance with
standards and the requirements of the Growth Manag'
Program and,
WHEREAS, the vacation of this excess right-of-way
facilitate settlement of the City of Carlsbad
DeLorm/Carlsbad Gateway condemnation suit and,
WHEREAS, the excess right-of-way provides no public pu
or usable access to adjoining properties and,
WHEREAS, the excess right-of-way has not been maintain
a public right-of-way for a period of five years or mor
NOW, THEREFORE, BE IT RESOLVED by the City Council o
City of Carlsbad, California, as follows:

particularly described as Exhibit A, and shown for the sal
clarity on Exhibit B, be summarily vacated.

the office of the County Recorder of said County, described as follows:
Beginning at the Southeasterly terminus of that certain course shown as "N
21"32'357r W 176.05 feet" on Record of Survey Map No. 10674 in the office of said County Recorder for a portion of the Southwesterly line of Parcel 1 as shown on Parcel Map No. 10060 in the office of said County Recorder, said terminus being also on a curve concave Southwesterly having a radius of 1863.00 feet, a radial line to said terminus bears North 57'44'56" East; thence North 21"32735ff West
