RESOLUTION NO. 90-142
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, CONCERNING
THE ACQUISITION OF REAL PROPERTY OWNED BY
2955 ELMWOOD STREET
JAMES A. AND IDA E. SCANLON, LOCATED AT
WHEREAS, upon completion of the new Library the presen
Library building will be renovated, and:
WHEREAS, additional land may be required to provide fc
Library expansion during the renovation, and:
WHEREAS, there is also a need to provide additiona
temporary office space for existing Library staff, and;
WHEREAS, there is a single family residence located a
2955 Elmwood Street, immediately adjacent to the presen
Library, and:
WHEREAS, this property is ideally suited to provide fc
the additional land required for Library expansion and fc
the present additional office space needs of the Library
and;
WHEREAS, the owner of the real property located at 295
Elmwood Street is willing to discuss City acquisition of th
property, and;
WHEREAS, sufficient funds exist in the General Fun
Unappropriated Fund Balance to provide for the acquisitic
of the real property at 2955 Elmwood Street, and;
NOW, THEREFORE, BE IT RESOLVED, by the City Council c
the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct

2. That the City Council appropriates $285,000 from
the General Fund Unappropriated fund balance, Acct.# 001-
820-6010-3900, to acquire the real property at 2955 Elmwood
Street.
3. That the City Council directs staff to negotiate
the purchase of the real property located at 2955 Elmwood
Street, at a total price not to exceed $285,000.
4. That the City Council authorizes the Mayor to
execute the purchase agreement only if total costs do not
exceed $285,000.
5. That the City Council authorizes staff to submit an
application for a Conditional Use Permit.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad City Council held on the 2 2nd day of
May ,1990, by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Pettine, Mamaux and Larson
NOES: None
ABSENT : None
