I/ v 0 1 2 3 4 5 6 7 8 9 10 21 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 90-297 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, CERTIFYING ENVIRONMENTAL IMPACT REPORT, EIR 86-5, FOR A PROJECT GENERALLY INCLUDING RESTORATION OF TIDAL FLUSHING TO BATIQUITOS LAGOON THROUGH DREDGING AND CONSTRUCTION OF A TIDAL INLET STRUCTURE. CASE NAME: BATIQUITOS LAGOON ENHANCEMENT PROJECT. APPLICANT: PORT OF LOS ANGELES CASE NO: EIR 86-5 WHEREAS, pursuant to the provisions of the Muni( Code, the Planning Commission did, on July 18, 1990, hold a noticed public hearing as prescribed by law to consider request: and WHEREAS, at said public hearing, upon hearing considering all testimony and arguments, if any, of all pe: desiring to be heard, and considering any written corm received, the Planning Commission considered all factors reli to the Master Plan; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Council of the City of Carlsbad as follows: 1. That the above recitations are true and corrc 2. That the findings and conditions of the Pla Commission Resolution No. 3072, including a statemen overriding consideration and supportive findings on file wit City Clerk and incorporated herein by reference constitutl findings of the City Council in this matter and that Environmental Impact Report, EIR 86-5, is certified and appr except as follows: ... c w * The City Council of Carlsbad, California sel 1 Alternative Mitigated A as the preferred enhancement alterna 2 3 continuously tidal inlet than does Mitigated B. for permit application purposes for the following reasons: 1. Mitigated A maximizes the amount of dredged 8 9 that would be available for nourishment of the regions seve eroded coastline. If during permit review by either the Corps 10 Engineers of the California Coastal Commission it is detem Council finds that Mitigated Alternative B is 11 that alternative Mitigated A cannot be permitted, then the is amended to replace IMitigated BIB with IMitigated A.@I foregoing, Section D of Planning Commission Resolution No. 13 the need for further review by the City Council.
