HomeMy WebLinkAbout1990-08-14; City Council; Resolution 90-298ll 0 1 2 3 4 RESOLUTION NO. 90-298 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SPECIAL USE PERMIT FOR A FLOODPLAIN ENCROACHMENT FOR THE BATIQUITOS LAGOON ENHANCEMENT PROJECT. CASE NO: SUP 90-9 APPLICANT: PORT OF LOS ANGELES 5 WHEREAS, pursuant to the provisions of the Munic 6 noticed public hearing as prescribed by law to consider 7 Code, the Planning Commission did, on July 18, 1990, hold a request; and 8 9 WHEREAS, at said public hearing, upon hearing 10 desiring to be heard, said Commission considered all fac 11 considering all testimony and arguments, if any, of all pel Council of the City of Carlsbad as follows: 14 13 relating to the Special Use Permit; and 12 NOW, THEREFORE, BE IT HEREBY RESOLVED by the 15 16 1. Mitigated A has a greater potential to maint 25 26 values 2. Mitigated A retains the existing wildlife ha 27 il *** 28 e a 1 3. Mitigated A maximizes the aerial extent of w surface at all tidal conditions therefore it creates a vi 2 resource that is desired by the community. 3 4. Mitigated A maximizes the amount of dredged that would be available for nourishment of the regions seve 4 eroded coastline. 5 If during permit review by either the Corps Engineers of the California Coastal Commission it is determ 6 that alternative Mitigated A cannot be permitted, then the environmentally acceptable and that it shall be approved 7 Council finds that Mitigated Alternative B is the need for further review by the City Council.
