RESOLUTION NO. 90-264
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A LOCAL FACILITIES MANAGEMENT PLAN AMENDMENT FOR LOCAL FACILITIES MANAGEMENT ZONE 12.
WHEREAS, a Local Facilities Management Plan has beer
prepared for Local Facilities Management Zone 12 in accordancc
with Chapter 21.90 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on May 16, Junt
6 and June 20, 1990, hold a duly noticed public hearing as
required by law to consider said plan and at the conclusion of
the hearing adopted Resolution No. 3040 making findings and
recommendations that the City Council adopt a Plan; and
WHEREAS, the Planning Director has determined that
the environmental effects of the project have already been
considered in conjunction with previously certified
environmental documents and, therefore no additional
environmental review will be required.
WHEREAS, the City Council at their meeting of July
31, 1990 held a duly noticed public hearing and considered all
/testimony and arguments of anyone desiring to be heard.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City
Council of the City of Carlsbad, California as follows:
1. That the above recitations are true and correct.
2. That the findings and conditions of Planning
Commission Resolution No. 3040, on file with the City Clerk and
incorporated herein by reference constitute the findings of the
City council in this matter except as amended by the addition
of the following conditions, are hereby approved:

Planning Commission Resolution No. 3040 is amended by th,
addition of the following conditions:
Conditions:
1. Prior to recordation of the first final map, issuance o
a grading permit or building permit, whichever occur,
first within Zone 12, the zone is required to participat,
in any current City-wide community facilities district 0.
provide an alternate financial guarantee to thl
satisfaction of the Finance Director for construction o
the improvements included in the City-wide communit:
facilities district.
2. Prior to recordation of the first final map, issuance o
a grading permit or building permit, whichever occur; first within Zone 12, a financing mechanism shall bl approved guaranteeing construction of a proportional sharj
of the following circulation improvements:
Improvements needed prior to 1998:
Rancho Santa Fe Road from Olivenhain Road to the souther] Carlsbad City boundary shall be constructed to include thc following:
A. Complete grading to ultimate right-of-way width tc major arterial standards:
B. Construction of four through travel lanes, two il
each direction, to include intersection improvement:
including a fully landscaped median.
3. That the Local Facilities Management Plan for Zone 12
dated May 16, 1990 on file with the City Clerk and incorporate(
herein by reference is hereby approved. Any developmeni
occurring within the boundaries of Zone 12 shall comply wit1
all the terms and conditions of said Plan.
