RESOLUTION NO. 90-348
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAL
AGREEMENT BETWEEN THE CITY OF CARLSBAD AND PGP CARLSBAl
SENIORS, LTD.
CALIFORNIA AUTHORIZING THE MAYOR TO EXECUTE A SUBORDlNATlO~
WHEREAS, in 1983 a Senior Housing Project was approved an
constructed which allowed for a density bonus and reduced parking; and
WHEREAS, the applicant as conditioned, submitted a conversion pla
and a subordination agreement naming the City of Carlsbad as the holder of th
second trust deed; and
WHEREAS, Jefferson House, A General Partnership is selling th
property to PGP Carlsbad Seniors, LTD; and
WHEREAS, pursuant to the Senior Housing Ordinance, Sectio
21.18.0045, security required by the ordinance is transferrable upon sale so Ion
as the buyer agrees to abide by the terms of this ordinance and the condition,
use permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Counc
of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
B) That the City Council authorizes the Mayor to execute the Subordinatio
Agreement between the City of Carlsbad and PGP Carlsbad Seniors, LTL
