RESOLUTION NO. 90-419
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD, CALIFORNIA,
REQUESTING MEMBERSHIP IN THE
CALIFORNIA MUNICIPAL INSURANCE
AUTHORITY (C.M.I.A.)

WHEREAS, the City has been self-insured for general liability purpose
since 1986; and
WHEREAS, the City has received a quotation for coverage from thl
10; California Municipal Insurance Authority; and
11 WHEREAS, pursuant to the provisions of the Government Code, th
12 City of Carlsbad wishes to enter into an agreement with various other public entitie
13

entitled Joint Powers Agreement Creating the California Municipal Insuranc
Authority (the "Joint Powers Agreement"), for the purpose of obtaining coverage i

16 /I the Liability Program of the California Municipal Insurance Authority ("CMIA'
17 created thereby, as more fully set forth in the Joint Powers Agreement; and
18 WHEREAS, the estimated Deposit Premium to be paid by this City fc

1 said liability coverage is the sum of $230,984; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of tl- 24
Section 1. That the City hereby authorizes Mayor Claude A. Lewis 1 26
City of Carlsbad:
WHEREAS, said Liability Program offers significant advantages to th
City, justifying the City's participation in such Liability Program, on the conditio1
hereinafter set forth, and is in the best interests of this City.

2 II Section 2. That the City hereby consents to participate in said Liabiliq

5 (a) The City's Deposit Premium for the Liability Program Yea.

Section 3. The City hereby selects $500,000 as its Self-Insured Retentio~
("SIR") for the Liability Program Year beginning on January 1, 1991 which SIR i
recognizes will be one of the factors to be utilized in computing this City'

Section 4. The City hereby selects $10,000,000 as its Limits of Liability fo 15
Retrospective Premiums and related Retrospective Premium Adjustments.

Section 5. The City hereby directs that $560,000 be appropriated from th
General Fund and transferred to the Liability Self-Insurance Fund. 19
Section 6. The City hereby designates Raymond Patchett, whose address j 20

Board of Directors, and Robert German as his alternate, to act on all matters comin 22
1200 Carlsbad Village Drive, Carlsbad, CA 92008, as its representative on CMIA
before said Board on behalf of the City, as a Member Entity, as if the City itself wer

Section 7. The Finance Director is hereby authorized to issue a warrant t 26
27 CMIA in the amount of $230,984 for its Deposit Premium for the Liability Progral

2 II Section 8. The City Clerk is directed to certify a copy of this Resolution an(
3 11 to forward the Resolution and the signed Joint Powers Agreement promptly by maj
4 to the California Municipal Insurance Authority, 7806 Madison Avenue, Suite 146, Fai
Oaks, California 95628.
