RESOLUTION NO. 90-430
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, MAKING APPOINTMENTS IN
A COMMUNITY FACILITIES DISTRICT
WHEREAS, the CITY COUNCIL of the CITY OF CARLS
CALIFORNIA, (hereinafter referred to as the ”legislative boc
the local Agency”) , desires to initiate proceedings to crea
Community Facilities District pursuant to the terms and PI
sions of the “Mello-Roos Community Facilities Act of 19
being Chapter 2.5, Part 1 , Division 2 , Title 5 of the Govern
Code of the State of California. This Community Facili
District shall hereinafter be referred to as COMMU
FACILITIES DISTRICT NO. 1 (hereinafter referred to as
“Distcict” ) ; and,
WHEREAS, at this time, the legislative body is desirou
making the required appointments in order to allow the proc
ings to go forward to completion in accordance with the pr
sions of law.
NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS:
SECTION 1. That the above recitals are all true
correct.
SECTION 2. That throughout the course of these proc’
ings, the City Council of the City will be acting as the legi:
, tive body of the Community Facilities District No. 1, a leg;
~ constituted governmental entity as defined by Section 53317

the Government Code of the State of California.
SECTION 3. All regulatory rules of the City, incluc
date, time and place of meetings, as well as notice requireme

2 shall be applicable for all proceedings conducted by this 1
3 I/ lative body as the governing body of the Community ~acil 411 ~istrict.
5 SECTION 4. That the CARLSBAD JOURNAL is hereby desig,
as the newspaper for all publications as required by law a]
necessary for completion of this District.

SECTION 5. That there is hereby authorized and establ-
a special revolving fund designated by the name of the Distr

11 I/ transferred to said fund to pay for current expenses, as wel

the acquisition and construction of facilities, inclu
engineering services, and said fund shall be reimbursed

tax revenues and/or other monies available from said Distric
from other contribution funds.
PASSED, APPROVED AND ADOPTED by the City Council of
City of Carlsbad at its regular meeting held on the 11th
of December , 1990, by the following vote, to wit
