HomeMy WebLinkAbout1990-12-11; City Council; Resolution 90-435I/ 0 0 .I II RESOLUTION NO. 90-435 1 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A NEGATIVE DECLARATION FOR THE CITYWIDE MELLO-ROOS DISTRICT/ COMMUNITY FACILITIES DISTRICT. 4 I/ WHEREAS, the City Council has determined to form 5 Il Citywide Mello-Roos District, pursuant to the terms a' 6 7 8 9 10 11 12 13 14 15 16 provisions of the "Mello-Roos Community Facilities Act of 198 being Chapter 2.5, Part 1, Division 2, Title 5 of t: Government Code of the State of California; and WHEREAS, the Citywide Mello-Roos District is bei formed to implement the City's Growth Management Plan, t General Plan, the Citywide Facilities and Improvements Plan a Local Facilities Management Plans, all of which have be previously adopted by the City Council: and WHEREAS, the Citywide Mello-Roos Community Faciliti, District is a project as defined by the Californ Environmental Quality Act (CEQA) and is, therefore, subject ' I? II environmental review: and 18 19 20 WHEREAS, on July 9, 1990, the Planning Direct' prepared a Negative Declaration determining that the Citywil I Mello-Roos District would not have a significant impact on t: 21 // environment: and 22 23 24 25 26 27 28 WHEREAS, the Negative Declaration was published July 21, 1990 in order to allow for public review and commen and WHEREAS, during the public comment period, o objection to the Negative Declaration was received; and WHEREAS, the Planning Director determined, aft reviewing the objection, that there was no substantial eviden 1 e e to indicate that the Citywide Mello-Roos District would have significant adverse impact on the environment and that Negative Declaration was adequate, legally proper and could supported by the environmental documentation including t initial study. 1 2 3 4 5 6 7 1. That based on examining the environment 9 documents including the initial study, analyzing all t lo information submitted by staff, considering any writt I' comments received and responded to by staff and considering a l2 testimony and arguments, the City Council finds that there l3 no substantial evidence that the formation and implementati I* of a Citywide Mello-Roos District will have any significa l5 impacts on the environment and the City Council hereby approv l6 17 a Negative Declaration.
