HomeMy WebLinkAbout1991-01-22; City Council; Resolution 91-29I- 1 2 3 4 5 6 7 8 9 10 I1 12 13 I* 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 RESOLUTION NO. 9 1- 29 RESOLUTION TO SPECIEV THE REVIEW AND APPROVAL PROCESS FOR SOLID WASTE TRANSFER FACILtTIES DESIGNED TO, AS A CONDITION OF THER PERMITS, RECOVER FOR REUSE OR RECYCLJNG LESS THAN 15 PERCENT OF THE TOTAL VOLUME OF MAERIAL RECEMD AND WHICH SERVE MORE THAN ONE JURISDICI3ON. WHEREAS, the State of California enacted AB 2296 which specifies the review and approval process for permitting of solid waste management facilities until a Countywide Integrated Waste Management Plan has been approved by the California Integrated Waste Management Board, and; WHEREAS, AB 2296 requires the Board of Supervisors, with the approval of a majority of the cities in the county containing a majority of the population of the incorporated area of the county, before February 1, 1991, to specify whether solid waste transfer facilities which are designed to, and as a condition of their permits shall, recover for reuse of recycling less than 15 percent of the total material received by the facility, and serve more than one jurisdiction, shall be subject to the review and approval process described in Section 50000 of the Public Resources Code, subdivision (b) or the review and comment process described in Section 4, subdivision (c); and WHEREAS, failure to spec9 which of the options shall be used, will result in the imposition of the review and comment process described in Section 50000, subdivision (c); and /// /// *c 1 2 3 4 5 6 7 8 9 3-0 11 12 13 l4 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e 0 WHEREAS, the review and approval process described in Section 50000, subdivision (b) is most like the procedure which has been used to approve prior County Solid Waste Management Plans and amendments thereto and affords the cities and the county the maximum participation available under AB 2296’s defined requirements; and WHEREAS, the San Diego County Integrated Waste Management Task Force and Technical Advisory Committee have approved the recommendation to select the review and approval process described in Section 50000, subdivision 0) ; NOW THEREFORE, the City of Carlsbad resolves as follows: The process described in Section 50000 of the Public Resources Code, subdivision (b) shall be used by the cities and County of San Diego for review and approval of solid wisste transfer facilities which recover less than 15 percent, by volume, of the materials processed and serve more than one jurisdiction. /// /// /// /// /// /// /// /// I* I I 1 2 3 # 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council held on the 22nd day of January 1991 by the following vote, to wit: AYES: NOES: None ABSENT: None Council Members Lewis, Kulchin, Larson, Stanton and Nygaa ATTEST: k KAREN R.
