91-55 RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA AUTHORIZING THE
EXPENDITURE OF FUNDS FOR SETTLEMENT OF THE
LAWSUIT ENTITLED POMERANCE V. CITY OF
CARLSBAD CASE NO. N33780
WHEREAS, on recommendation of the City Attorney thl
City Council of the City of Carlsbad, California has determi
that a settlement in the case entitled Pomerance v. City of
Carlsbad is in the public interest: and
WHEREAS, there are sufficient funds available in t
liability self-insurance reserve account to pay the settleme
NOW, THEREFORE, BE IT RESOLVED by the City Council
the City of Carlsbad, California, as follows:
1. That the above recitations are true and correc
3. That the City Council approves the settlement
authorizes disbursement of $13,500 from the liability self-
insurance reserve account for Pomerance v. City of Carlsbad.
3. That the Agreement to Settle is hereby approve
PASSED, APPROVED AND ADOPTED at a Regular Meeting
the City Council of the City of Carlsbad on the 19th dz
of February , 1991, by the following vote, to wit:
AYES: Counci Members Lewis, Kulchin, Larson, Nygaard and S
NOES: None.
