WHEREAS, the City Council of the City of Carlsbad has the authority t establish fees for City services; and WHEREAS, from time to time said fees are reviewed and evaluated t maintain an adequate fee structure recovering costs for City services; and WHEREAS, sewer use charges and costs must be distributed on the bas: of benefits received; and WHEREAS, a system allocating charges based upon flow rates an percentage of suspended solids would meet the above requirement; and WHEREAS, the City Council finds that, pursuant to Section 15273 ( Division 6 of Title 14 of the California Code of Regulations, the restructuring ( sewer fees to meet operating expenses is exempt from the provisions of th California Environmental Quality Act; and WHEREAS, the City Council has determined the cost of providing generi City services; and WHEREAS, the City of Carlsbad Wastewater Revenue Prograi September, 1990 has been made available to the public and is on file in the Offic of The City Clerk; and WHEREAS, the City Council has held the necessary public hearings an allowed for public comment on the establishment of said fee. 1 2 3 4 5 ' 7 8 0 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 NOW, THEREFORE, BE IT RESOLVED by the City Council of the Cit of Carlsbad, California that the fee schedule shown in Exhibit A attached heret is hereby adopted and shall become the official fee schedule for the City ( Carlsbad based upon the City of Carlsbad Wastewater Revenue Program 199( Any fee area not included in said plan shall remain under control of any previou ordinance or resolution adopted by this Council. All fees shall become effective o June 1, 1991. These are Gro I - Residential; Group I1 - Low Strength Commercial; Group 111 - Medium Streng Commercial; Group IV - High Strength Commercial; Group V - Institutional and Group \ Large Volume Users. Low strength users are those whose combined strength expressed in terms of biochemic oxygen demand (BOD) and suspended solids (SS) is less than 400 milligrams per Lii (mg/L). This group includes car washes, offices, retail stores, laundromats, warehoust hospitals and convalescent homes, and indoor theaters. Medium strength users are those whose combined strength is at least 400 mg/L but le than 1000 mg/L. This group includes hotels/motels without restaurants or kitcher service stations, shopping centers, commercial laundries and industrial users. High strength users are those whose strength is 1000 mg/L or greater and includ restaurants, bakeries, food processors, supermarkets, mortuaries and hotels wi restaurants. Institutional users are schools and membership organizations like churches and soci service clubs. Residences ha1 a flat rate of $11.58 per month. All other customers pay based on their watc usage and each group's unit cost per hundred cubic feet of water used ($/HCF subject to a minimum monthly charge of $11.58. Customers with pretreatment facilities are grouped into classes depending upon the numbe of inspections required during a year. Class I facilities require quarterly inspections anc an annual permit while Class I11 customers require annual inspections and a three-yea permit. Class I $3,000 per year $250 per month Class 11 $1,800 per year $150 per month Class 111 $300 per year $25 per month The City Council, from time to time, will review and adjust fees to recover costs for thesc services. SEWER LATERAL INSTALLATION To ensure actual costs for such services are recovered, a deposit of $2,500 per lateral installation shall be required.
