HomeMy WebLinkAbout1991-06-04; City Council; Resolution 91-170L 4 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 0 0 CITY COUNCIL RESOLUTION NO. 9 1 - 17 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A REQUEST FOR AN EXTENSION OF TIME [H ILLS I DE P ARTN E RS) WHEREAS, the Planning Commission did on June 7, 1989 adopt Resolution F FOR A TENTATIVE TRACT MAP FOR CARLSBAD TRACT CT 88-5 2871 approving the tentative map for a 13 lot subdivision, known as CT 88-5, and WHEREAS, said tentative map will have expired as of June 7, 1991, and WHEREAS, the applicant for the tentative map, Hillside Partners has requested extension of time to process toward a firial map, and WHEREAS, the project can be found to be in conformance with the General PI current City ordinances and current City policies with imposition of additional conditic and WHEREAS, Hillside Partners has consented to the imposition of the additic conditions which are needed to bring the tentative tract map into conformance with General Plan, current City ordinances and current City policies. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsts California, as follows: 1. 2. That the above recitations are true and correct. All landscape plans shall be prepared to conform with the Landsce Guidelines Manual and submitted per the landscape plancheck procedui on file in the Planning Department. Landscape plans shall be designed to minimize water use. Lawn i other Zone 1 plants (see Landscape Guidelines Manual) shall be limii to areas of special visual importance or high use. Mulches shall be uh and irrigation equipment and design shall promote water conservatior The developer shall avoid trees that have invasive root systems, prod1 excessive litter and/or are too large relative to the lot size. Prior to final occupancy, a letter from a California licensed landscc architect shall be submitted to the Planning Director certifying that landscaping has been installed as shown on the approved landsc: plans. All herbicides shall be applied by applicators licensed by the State California. The applicant shall pay a landscape plancheck and inspection fee required by Section 20.08.050 of the Carlsbad Municipal Code. The first set of landscape and irrigation plans submitted shall inch building plans, improvement plans and grading plans. All landscape and irrigation plans shall show existing and propo! contours and shall match the grading plans in terms of scale and local of improvements. Mature trees which are removed shall be replaced one to one \i minimum 36 box specimen. Each case shall be reviewed by the Planr Director. The applicant shall make a diligent and concerted effort to prevent fur unauthorized dumping on the project site. The entire potable and non-potable water systems for subject project sha be evaluated in detail to insure that adequate capacity and pressure fc domestic, non-potable and fire flow demands are met. The Developer's Engineer shall schedule a meeting first with the City Fir Marshal and then with the District Engineer to review the preliminary watt system layout prior to preparation of the water system improvement plan: The Developer will be responsible for all fees and deposits plus the majc facility charge which will be collected at time of issuance of building perm The Developer shall pay a San Diego County Water Authority capaci charge which will be collected at issuance of application for met installation. "This project is approved upon the express condition that building permi will not be issued for development of the subject property unless the wat district serving the development determines that adequate water ar service is available at the time of application for water service and H continue to be available until time of occupancy." A note to such effe shall be added on a non-mapping sheet of the final map. The Agreement of Waiver of Prohibition Against the Imposition Q. R. S. 3. Any le challenge to or failure to perform said agreement or the conditions of this resolution SI render this approval void and the map shall not be final.
