HomeMy WebLinkAbout1991-06-25; City Council; Resolution 91-199L Lt 1 2 3 4 5 6 7 a 9 10 I1 I-2 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 e e RESOLUTION NO. 9 1 - 19 9 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD SETTING COMPENSATION, BENEFITS AND CLASSIFICATIONS FOR EXISTING WATER DISTRICT EMPLOYEES WHEREAS, the Carlsbad Municipal Water District (District) became a subsidiary dis of the City of Carlsbad (City) on January 1, 1990, and; WHEREAS. the purpose of this change in the institutional relationship between District and City was to provide a unified water service operation for the District’s service a and; WHEREAS, a list of terms and conditions under which the subsidiary district will ope was approved by the governing bodies of both agencies prior to its formation, and; WHEREAS, the list specifies that the salaries and benefits of all full-time Dist employees on January 1, 1990, will remain at a level not less than currently enjoyed. NOW THEREFORE, the City Council of the City of Carlsbad, in an effort to provide most efficient water delivery system for Carlsbad, and in full conformance with the terms : conditions of the subsidiary district formation, desire to perform the following actions: 1. Add the attached listing of District positions to the City’s existing personnel struct and maintain the salary ranges for those positions at the level specified in Exhibit A. 2. Retain the benefits of the employees listed on Exhibit A for the duration of their ten1 at that position. The level of benefits to be retained is included as Exhibit B. 3. Add the attached classifications to the City’s existing personnel structure as shown Exhibit C. The ewing benefits will remain at their c@,nt level as specified in the subsidiary district agreement between the City of Carlsbad and the District. b ARTICLE 4- WORKING HOURS, EMPLOYEE BENEFITS Sec. 4.1 Overtime. Employees of the District shall be on call twenty four (24) hours a day during the course of their employment, and upon instructions of the General. Manager, shall work during any emergency affecting operations of the District. All employees are required to obtain and maintain a telephone at their residence, and the telephone number shall be listed in District personnel files. Overtime shall be defined as work performed before or after the regularly scheduled work day or work work day shall be paid at the rate of time and one- worked on Sundays and Holidays shall be paid at double time. 1. Standby. Two employees shall be on standby at all times. Each such employee shall remain on standby for a one-week period and shall receive $100 per week for the standby period. The employee shall be compensated in the :normal manner for any work performed. Standby call shall not be regarded as call back work. 2. Call Back. Call back is work required of an employee who, following completion of the employee's work day and departure from the employee's work site, is ordered to report back to duty to perform necessary work. To qualify for this call back provision, an employee must leave the place from which the employee is called and actually report to a work site and/or the office. An employee who is called back as defined above shall receive a minimum of two hours time at the rate of time and one-half pay for regular overtime, or double time on Sundays or holidays. In lieu of pay, compensatory time may be accumulated to a An maximum of forty hours per fiscal year. employee not using the compensatory time shall be paid for the time prior to the end of the fiscal year on June 30. Overtime work in conjunction with regular scheduled work day, either beginning earlier or working past normal scheduled work day, is not call back work. Sec. 4.2 Vacation leaves. Vacation time is intended to provide a rest and change for the employee. For this reason, all employees are encouraged to take week. Work in addition to the regularly scheduled half of an employee's pay. In addition, all hours e at least five (5) consecutive work days of their annual vacation time during each year of their employment. At the discretion of the General Manager as to setting the period of time to be taken for any vacation leave, all full-time employees will be granted such leave with pay under the following conditions: (a) Earninss Rates. After completion of one year of employment, each employees shall be granted vacation time of 80 hours. The employee then per pay period. After the completion of five continuous years of employment, an employee shall be granted vacation time at the rate of 4.62 hours per pay period. After completion of 10 continuous years of employment, an employee shall be granted vacation at the rate of 6.15 hours per pay period. After completion of 20 years of continuous service an employee shall be granted vacation at the rate of 7.69 hours per pay period. (b) Carryover of Unused Vacation Hours. Vacation time accumulation as of January 1 each year may be permitted as follows: Employees with less than 5 years service --- 160 hours begins earning vacation at the rate of 3.08 hours Employees with 5 but less than 10 years service --- 24 0 hours Employees with 10 but less tham 20 years service--- 3 2 0 hours Employees with 20 or more years of service --- 400 hours Effective January 1, 1987, and each January 1 thereafter, vacation time in excess of the above- mentioned hours will be elimiinated. (c) Schedulinq. Prior to January 1 each year, employees shall schedule their vacation times for the next year with their supervisors. The vacation schedules will be consolidated into one summary schedule which the General Manager shall approve. Any and all changes in scheduled vacation times must be requested by the employee in writing 5 days prior to reserved time and must have approval of the General Manager. e 0 (d) Rate of Pay. Pay for vacation leave shall be at the nonthly rate currently paid the employee at the time the vacation is taken. Service shall be deemed to be continuous if employment by the District has not been interrupted for a period in excess of 30 days, or where the District has terminated an employee due to lack of work and later rehired the employee. (e) In computing the amount of vacation leave due an employee, holidays, vacation time, and sick leave shall be included as total service and the period of time to be granted to an employee shall be in addition to Saturdays, Sundays and Holidays within or at the beginning or end of such leave. Sec. 4.3 Sick Leave. Sick leave is defined as the necessary absence from work of an employee because of illness, injury or exposure to contagious disease suffered by the employee, or the serious disability of the employee while on a scheduled vacation, or absence authorized for medical or dental care. Employees shall be entitled to sick leave with pay under the following conditions: (a) Each full time employee shall be entitled to 96 hours sick leave per one year of employment. (b) Sick leave may be accumulated for an unlimited period. Additional sick leave may be granted at the discretion of the Board of Commissioners and approval thereof. (c) Abuse of sick leave privileges shall be grounds for discipline or dismissal. (d) In computing the amount of sick leave time due an employee, holidays, vacation time and sick leave shall be included as total service and the period of time to be granted to an employee shall be in addition to Saturdays, Sundays, and holidays within or at the beginning or end of such leave. (e) An employee has the option of selling back to the District 100% of any accumulated sick leave in excess of 250 hours. (f) The Board of Commissioners, at its discretion, may purchase any accumulated sick leave from an employee. a c Sec. 4.4 Jury Duty. All employees are eligible for jury duty leave with pay when required by any legally constituted court to appear for examination or jury service, In order to qualify for paid jury duty leave, employees are required to furnish proof of attendance in a manner prescribed by the General Manager. An amount equal to the per diem or fees paid by the court to the employee will be deducted from the employee's pay. No deduction will be made for the value of mileage allowances, meals or lodgings furnished by the court. In the absence of proof of attendance, an employee will be required to use such other leave as is prescribed by the General Manager. Sec. 4.5 Bereavement Leave At such time as there is a death in an employee's immediate family, the General Manager is authorized to grant up to a maximum of 3 days leave with pay, subject to employee 1 s written request for such compensation. Written request shall contain the following information: ... Name of deceased ... Relationship to employee ... Date of funeral and services ... Place where funeral or services will be held ... Date of employee's return to work Such paid leave, if approved, is not to be charges against employee's vacation leave. All Bereavement Leaves must have prior approval of the General Manager. Employee is eliqible for Bereavement Leave for abortion or miscarriage. Immediate family is defined as: Spouse, child, parent, brother, sister, grandparents, mother-in- law or father-in-law, brother-in-law, sister-in- law. Two (2) days of sick leave time may be used in conjunction with Bereavement Leave. Employee must have the necessary hours accumulated in order to qualify for this additional time off. Prior approval of the General Manager is necessary. e 0 See. 4.6 Leave Without! Pay UT Leave of Absence 1. Leave without pay or leave of absence when necessitated by illness or injury may be granted by the General Manager to a staff member or employee of the District only after exhaustion of all accumulated sick disability and vacation leave for a period not to exceed six (6) months and in accordance with the monthly guidelines as established in (3) below. Unless specifically authorized by the Board of Commissioners for a longer period, a staff member or employee of the District who, due to illness or injury, has taken leave without pay in eycess of thirty (30) consecutive calendar days, shall be required to provide a Physician's Statement attesting to his/her fitness based upon the normal duties pursuant to his/her job description before returning to work. 2. Leave necessitated by pregnancy, childbirth, miscarriage or related medical condition: An emplcyee affected by pregnancy, childbirth, or related medical conditions may take an unpaid leave of absence of absence for a reasonable time, not to exceed four months. A reasonable time is that period during which the female employee is disabled on account of pregnancy, childbirth or related medical conditions. This time does not include time for maternity or child care leave. An employee affected by pregnancy, childbirth, or related medical conditions must give the District reasonable notice of the date the leave of absence will begin and the estimated length of leave. Reasonable notice is that time prior to taking leave when the employee knows the estimated date the leave of absence will begin. If the employee returns within four months, she will be reinstated to her former position, unless the job ceases to exist because of legitimate business reasons or the District was unable to leave the position unfilled or fill it with temporary employees. If the employee is not returned to her original job Leave necessitated by illness or injury: a 0 she will be given a substantially similar job, unless there is no substantially similar position available or the substantially similar position is available, but filling the available position with the returning employee would substantially undermine the District's ability to operate safely and efficiently. When the leave of absence exceeds four months, then the provisions of Section 4.6 (1) and (3) governing leave without pay or leave of absence become applicable to that employee. If the employee is temporarily disabled because of pregnancy, childbirth or related condition, but is able to work in a less strenuous or hazardous position, the General Manager may transfer that employee, upon request, to a less strenuous or hazardous position, unless the General Manager finds denial of the request necessary for the safe and efficient operation of the District. BENEFITS An emplcyee who requests a leave of absence because of pregnancy, childbirth or related medical conditions, shall use accrued sick leave and vacation leave, as permitted by Sections 4.2 and 4.3. Consecutive Days 3. Guidelines Leave Allowed One year of less of employment 30 days Two to three years 60 days Three to four years 90 days Four to five years 120 days Five to six years 150 days Six years or more 180 days Vacation and sick leave benefits, if any, shall not accrue during any period of leave without pay. The employee will be restored to his/her former position when he/she returns from leave of absence. If the position has been abolished or terminated during his/her absence, he/she will be reinstated to a position of similar seniority or status. The employee will receive the same vacation, sick leave and holiday privileges and the same opportunities for promotion as he/she would have received had he/she not taken the temporary leave without pay or leave of absence. L t a Q Request for consideration of leave of absence not covered by the foregoing provisions shall be referred to the Board of Commissioners for decision. The Manager shall not extend leave under this policy to any employee more than one time during any single calendar year. 4, Military Leave: A. Active Military Duty 1. Eligibility Any District employee who is a member of the reserve corps of the armed forces of the United States, National Guard or the Naval Militia is entitled to a military leave of absence while engaged in military duty ordered for purposes for active military training, encampment, naval cruises, special exercises or like activity. This leave ordinarily may not exceed 180 calendar days, including time involved in going to and returning from duty, and reinstatement rights will be granted as required by state and federal law. 2. Pay and Benefits If the employee has been with the District for at least one year prior to the beginning date of the requested active military leave, the employee will receive his or her regular pay for the first thirty (30) days of the leave and will receive the same vacation sick leave and holiday privileges and the same opportunities for promotion and reemployment the employee would have received had the employee not taken the active military leave. For purposes of determining this one year of service, all service of the employee in any counted as service with the District. 3. Active Duty During Emergency Regardless of the employee's length of service, any District employee may take active military leave during a state of extreme emergency as declared by the recognized military service shall be I r a a Governor of California or othemise provided by law. During such active emergency military leave, the employee will receive his or her regular pay for the first (30) days of the leave. B. Military Training Leave Any District employee who is a member of the State Military Reserve is entitled to a temporary leave of absence without pay while engaged in military duty for purposes of military training, drills, unit training assemblies or similar inactive duty training, for up to 15 calendar days annually, including time involved in going to and returning from that duty. Sec. 4.7 Holidays. The business office of the District shall remain open from 8:OO A.M. to 5:OO P.M. Monday through Friday of each week of the year, except upon the following designated Holidays: January 1st (New Year's Day) 2nd Monday in February (Lincoln Day) 3rd Monday in February (Washington Day) Last Monday in May (Memorial Day) July 4th (Independence Day) 1st Monday in September (Labor Day) 2nd Monday in October (Columbus Day) November 11th (Veteran's Day) Thursday designated Thanksgiving Day Friday after Thanksgiving Day December 25th (Christmas Day) In the event that a Holiday falls on a Saturday, the previous Friday shall be considered a Holiday; in the event that a Holiday falls on a Sunday, the following Monday shall be considered a Holiday. The District office shall be considered closed on the day designated by the State of California. One Elective Dav as a Holiday. In addition to the above Holidays, each employee shall be entitled to eight (8) consecutive hours off with pay of his/her choice per each twelve (12) month period within the following limitations: 1. Employee must obtain supervisory approval of the elective day at least 30 days in advance of the day selected. e a 2. New employees are not eligible for the elective holiday until successful completion of one year of employment with the District- Full-time employees shall be compensated for eight hours' pay for each of the above-designated holidays. The General Manager shall develop a schedule of holidays to provide for the Field Operations 10 hours per day employees. Any employee on leave of absence without pay during a designated holiday date shall not receive compensation for said holiday. Each employee shall be entitled to holiday time off for each designated District holiday. If a District designated holiday falls within an required to work, or if an employee is called back to work on a regularly scheduled holiday, the employee shall be compensated at a rate of double time in addition to holiday pay. To be eligible for holiday pay, an employee must work or be on an approved paid absence the working day preceding and the working day following a legal holiday on which the District office is closed. The Supervisor shall report to the Personnel office any employee not eligible for the holiday pay. Sec. 4.8 Health Insurance and Life Insurance. The District will provide each full-time employee and his/her dependents with a choice of ACWA-Blue Cross Prudent Buyer, ACWA-California Care, or Kaiser health insurance. The District will provide either of the two ACWA policies at no cost to the employee, and will contribute an amount not to exceed the cost of the ACWA policy toward the Kaiser program at the option of the employee. The District will provide each full-time employee a life insurance policy or group policy, as determined by the Board of Commissioners, which will provide a reasonable amount of protection or coverage at no cost to the employee. This will be followed by a physical examination, the cost to be paid by the District. employee's normal work week and the employee is e 0 If the retiree divorces, neither his new spouse nor his former spouse will be eligible for coverage and it shall cease immediately and be terminated. The former spouse would only be eligible for continued health care coverage at his or her expense, as required under federal law. Sec. 4.9 Disability Insurance. The District shall provide all employees a Group Disability Insurance Plan. The cost of such premiums shall be borne entirely by the District. Sec. 4.10 Credit Union. The District will permit a payroll deduction bi-weekly for those employees who wish to avail themselves of the services of the San Diego County employees' Credit Union. Sec. 4.11 Retirement Plan. In accordance with an agreement between the District and the Public Employees' Retirement System, all full time employees shall be enrolled as members of the System. The District contributes both the District's and employee's share of the costs. Part time employees are not eligible for membership in the Public Employees' Retirement System unless they work at least 30 hours per week on a regular basis. Sec. 4.12 Unemployment Insurance. The District does participate in the State Unemployment Insurance Program. Sec. 4.13 Workers' Compensation Insurance. The District is covered as required by California law, by Workers' Compensation Insurance. All employees, without exception, are therefore afforded the protection and benefits provided by Workers' Compensation Insurance. Injury Leave Definition: Injury leave means a paid absence from duty as a result of a job-related injury. Elisibility for Injury Leave Shall be as Follows: A. Injcry leave may be granted only during the period the employee is unable to perform his/her duties and is entitled to Workers' Compensation temporary benefits. No injury leave may be granted during the first three days after the employee leaves work as a L * 0 An employee shall not be entitled to any benefits effective the day following the day that the status of employment is terminated. The day of termination is not extended through the period of accumulated vacation or sick leave the employee is entitled to as of the date of termination. Effective January 1, 1987, terminated employees who leave for reasons other than gross misconduct on with their dependents, for continuation of health insurance coverage to be paid by the employee as required under federal law. The District will continue to pay, after retirement of an employee, premiums for existing health insurance provided for District employees: 1. Who have voluntarily retired after the age of 50 with no less than five years of service with the District, and whose age combined with years of service with the District equals 70 or more; or 2. Who have retired by having reached the mandatory retirement age established under the State of California Public Employees' Retirement the District; Health insurance coverage for the retiree will be coordinated with Medicare and other benefits provided by federal and state law and will thereby be reduced when the retiree qualifies for those benefits ; health insurance coverage for the spouse and dependents of a retiree will be coordinated with Medicare and other benefits provided by federal and state law, and will thereby be reduced when the spouse qualifies for those benefits. Upon death of the retiree, health insurance coverage for the spouse and dependents will be continued, provided the spouse keeps the District status. In the event such spouse remarries, his I her eligibility for such coverage ceases immediately and shall be terminated. Injury leave shall not be granted for C. aggravation, recurrences or sequences of a preexiscing non-service-connected physical disability or any physical condition existing prior to employment by the District; provided, however, that this subsection shall not disqualify an employee otherwise entitled to sick leave under other conditions and sections. Sec. 4.14 Educational Reimbursement. The District encourages The educational advancement of its personnel. purpose of the reimbursement program is to provide financial assistance to those employees who voluntarily engage in educational pursuits beneficial to the District. Although any employee who uses his leisure hours to develop his skills and knowledge is to be commended, the District cannot assume financial responsibility for all such pursuits. Employee educational reimbursement is confined to expenses for voluntary, off-duty development which benefits both the employee and the District. 1. employee leaves work or is hospitalized as a result Where the employee's gross ELIGIBILITY OF COURSES FOR REIMBURSEMENT The following criteria will be used in determining the eligibility of courses for reimbursement: m e a. Courses must be: 1. Related to the employee's work, or 2. Related to District work which the employee can reasonably be expected to perform in the future, or 3. Included in the required or elective curriculum for a degree related to the employee's work or related to District work which the employee can reasonably be expected to perform in the future. b. Courses must be taken on employee time. C. Courses must be taken at accredited colleges or universities, approved trade schools, or with approved correspondence short courses, institutes, etc., are not to be considered a part of this program. schools. Conventions, seminars, workshops, 2. ELIGIBILITY OF EMPLOYEES FOR REIMBURSEMENT The following criteria will be applied in determining the eligibility of employees for tuition reimbursement: a. Permanent full time employees with a minimum of 6 months' service are eligible for reimbursement. b. Employees who are eligible for Veterans' educational benefits fromthe Federal and State governments are eligible for additional reimbursement from the District to the extent of the difference between the total amount of such education benefits received fromthe State or Federal government and the total amount of tuition, registration fees, textbooks and laboratory fee. 3. NATURE OF REIMBURSEMENT a. Reimbursement will be 60% of all costs for approved courses, including but not limited to tuition registration fees, textbook costs ( including tax) , and laboratory fees. Reimbursement will be limited to courses providing for a maximum of twelve units per quarter or semester. m e b. Expenses for parking, travel, meals and other incidentals are not reimbursable. c. Reimbursement will be made to the employee upon completion of the course with a minimum No final grade of C or its equivalent. reimbursement will be made for audited courses or incomplete courses. 4. REIMBURSEMENT LIMITATIONS Employees are expected to remain in District service for at least one year after completing a reimbursed course. If an employee to whom such reimbursement has been made, leaves the District service voluntarily or is discharged for cause within one year after completing a reimbursed course, the amount of such reimbursement will be reimbursed forthwith and may be via deduction from the employee's final paycheck. An employee leaving District employ under threat of layoff resulting from a reduction in force shall not be deemed to be leaving District service voluntarily. 5. PROCEDURE FOR REIMBURSEMENT a. Employee applies for tuition reimbursement through normal supervisory channels. b. The General Manager either recommends approval of the application or denies it based on the guidelines set out herein. If the General Manager recommends approval the application is then forwarded to the Board of commissioners. The Board of Commissioners evaluates request for reimbursement and makes final appraval or denial. d. Upon completion of an approved course, employee presents verification of fees paid and grade achieved to the General Manager. e. Upon approval by the General Manager the application for reimbursement is forwarded to the Controller for processing. If employee leaves District service f. voluntarily, or is discharged for cause within one year after completing a reimbursed course, deducts reimbursement from final paycheck or otherwise arranges immediate payback to C. the General Manager notifies the Controller who 0 0 District. Sec. 4.15 Lonsevitv Pay. Each classified regular employee in the District service will be eligible for longevity allowance as follows: After five (5) years of service in the same classification at E step, an employee shall be entitled to an allowance of 5% in addition to any other regular pay, i.e. C.O.L.A., that he or she is entitled to. The employee is then placed at the LI step. After an additional five (5) years an employee shall be entitled to a 2-1/2% increase in addition to any other regular pay that he or she is entitled to and is then classified as an L2. Effective July 1, 1989 an additional one-time $1,500 net award will be given to all employees who reach L2 and every five (5) years thereafter. Sec. 4.16 Senioritv. Seniority shall mean the status attained by length of continuous service with the District. Seniority shall be determined from the day of an employees official appointment to District service. An employee shall have no seniority until completion of at least six (6) months service with the District, at which time the employee will acquire seniority from the date of accrue no seniority in the new position until completion of six (6) months in pay status in the new position. The employee's total seniority with the District will be credited. Any disagreement over the application of any method of applying seniority utilized by any department will be subject to the grievance procedure. Sec. 4.17 Dental Insurance. The General Manager may recognize other certifications according to their comparability to the above-defined award levels. Sec. 4.21 Special Housinq Facilities. The District maintains a residence at Squires Dam. The purpose of this residence is to provide security for District facilities. The following conditions apply to employee assignment as caretaker; 1. Employee Status. The employee assigned as caretaker at Squires Dam shall be a full-time permanent employee. 2. Priority of Assiqnment. In the event of a vacancy at the caretaker residence, priority of assignment shall be operations crew members first and construction crew next. Within crew members, longevity with the District shall be the second criterion. e 3. Sole Place of Residence. The crew member assigned as caretaker shall maintain the residence as his/her sole place of residence. 4. Others Livins at Residence. Only District employees and a reasonable number of persons who constitute a bona fide single housekeeping unit shall be allowed to reside at the house. 5. ResDonsibilities. The employee, and not the District, shall be responsible for the general maintenance of the house and surrounding property, The employee shall also be expected to provide security during nonworking hours by having themselves, a member of their household or another District employee on-site four weeknights per week and at least three weekends per month. The employee shall be expected to respond to emergency situations to include the chlorination facility, the hydroelectric facility and the mobile chlorination equipment. The employee shall make a visual inspection of the entire site at least weekly and shall repair any minor fence breaks. The employee shall drive a District vehicle. No more than three private vehicles shall be kept at the residence. No overtime or supplemental compensation shall be paid for these duties. 6. Rent. The District shall charge an appropriate rent for the residence. Said rent shall be established from time to time by the Board of Commissioners. The District shall furnish the water supply and electricity for the residence and the District employee shall be responsible for the balance of the utilities. Upon change of resident the District shall have the propane tank filled and bill the outgoing resident. 7. Firearms. The employee shall not carry any firearms in the performance of his/her duties as caretaker nor in District vehicles and shall not discharge any firearms on District property. 8. Parties. The employee shall notify the General Manager in advance of any party at the residence involving 15 or more people. 9. Pets. The employee shall be allowed to have only non-house pets and any pets shall remain within the fenced portion of the property provided for this purpose. The employee may not keep pets known to be vicious. 1 e e 10. Terms. The District maintains the right to change the assignment of the caretaker responsibility based solely on determination of the District. It is the intent of this provision to create an at-will tenancy. There shall be an annual review of the caretaker's performance with the Superintendent and General Manager. Sec. 4.22 Deferred Compensation. The District has established a Deferred Compensation Plan which employees may voluntarily participate in. The District matches employee contributions up to a maximum of 7.5% of an employee's bi-weekly Sec. 4.23 Third Level 1959 Survivor Benefit. The District shall fund the employer's contribution for the Third Level of the Public Employees Retirement System (P.E.R.S.) 1959 Survivor Benefit Program.
