(ASSESSORS P DECLARING THE CITY'S INTENTION TO HOLD A PUBLIC HEARING 01 ABATEMENT OF NUISANCE: ACCUMULATION OF WEEDS AND DEBRIS AN ABANDONMENT OF THREE STRUCTURES. I NUMBERS; 206-1 20-01, 02, 10 AND 1 1) AS A POTENTIAL PUBLIC NUISANC 6 9 exhausted all means of enforcement; and, 8 of three partially demolished structures and the accumulation of trash and debr 7 WHEREAS, the City, in response to a number of complaints regarding the abandc 10 WHEREAS, the conditions existing on assessors parcel numbers 206-120-01, and 1 1, constitute a public nuisance as defined in Title 6, Section 6.1 6.01 0; Subsect "11 and (2) of the Carlsbad Municipal Code, 12 13 14 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of C: California, does hereby resolve as follows: 15 16 1. That the above recitations are true and correct. 2. That the City has the power at both common law and by ordin 17 11 abate nuisances. I.8 I 3. That the City Council has established procedures for the abate1 19 1 certain nuisances within the City limits. 20 4. That a potential threat to the safety of the general public exists as 21 22 of the conditions existing upon the subject property. 23 24 25 26 27 28 5. .That the City Council will hold a public hearing on /1z!Arck / L 1992 in the City Council Chambers at 1200 Carlsbad Village Drive, Carlsbad, Calif consider whether or not the conditions constitute a public nuisance, that if a public r is found to exist it will be ordered abated at the expense of the property owners persons causing or maintaining the nuisance and such expense shall become a lien anc assessment against the property. 1 I1 m * II 6.
