RESOLUTION NO. 9 2 - 6 6
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A QUITCLAIM FOR AN
EASEMENT ORIGINALLY DEDICATED TO THE CARLSBAD
MUTUAL WATER COMPANY AT 3475 CHARTER OAK DRIVE.
WHEREAS, Kevin E. McCann and Deborah S. McCann have submitted a request f
quitclaim of a water easement which was originally dedicated to the Carlsbad Mutual Wat
Company over a portion of their property located at 3475 Charter Oak Drive; and, , WHEREAS, the City of Carlsbad is the successor in interest to the Carlsbad Mutu
Water Company; and,
I WHEREAS, said easement was never utilized for the purpose for which it was grant<
and is not now nor is it contemplated to be needed for the purpose of waterline installatio
~ and,

~ WHEREAS, the City Council of the City of Carlsbad has determined it to be in tt
~ public interest to quitclaim said easements;
I I NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsba
~ California, as follows:
~ 1. That the above recitations are true and correct.

~ 2. That the Quitclaim Deed conveying water easements over a portion of APN 16
' 124-03 to Kevin E., McCann and Deborah E. McCann which is on file with the City Clerk ar
is incorporated by this reference; is approved.

3. That the Mayor is authorized to execute the original Quitclaim Deed and
City Clerk is hereby authorized to cause the original Quitclaim Deed to be released to
property owners to be recorded in the office of the County Recorder of San Diego COL
State of California.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City COL
held on the 3rd day of March , 1992 by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Larson, Stanton and NJ
NOES: None
ABSENT: None
