RESOLUTION NO. 92-67
A RESOLUTION OF THE CITY COUNCIL OF CARLSBAD CALIFORNIA
APPROVING AN ADDITIONAL APPROPRIATION OF $12,500.00 TO UTILITIES
AND MAINTENANCE ACCOUNT NO. 001 -820-51 10-2412.
4 WHEREAS, the City recently settled a lawsuit entitled Homes bv Polvnon vs City; a
5 WHEREAS, a part of the settlement required Homes by Polygon to pay to the City
6 sum of $1 2,500.00 for the repair of defective street improvements in CT 81 -1 6, Vista Santa
7
WHEREAS, it is in the public interest to repair the defective street improvement: 8
and,
9 quickly as possible.
10 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlst:
11 California, as follows:

1. That the above recitations are true and correct.
2. That the City Engineer is hereby authorized to effect repairs on the defec
l4 /I street improvements in CT 81 -1 6, Vista Santa Fe, by appropriating the $12,500.00 from

settlement of Homes bv Polvson vs Citv and depositing it into Utilities and Maintenai
Account No. 001 -820-51 10-241 2. 17

PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City COUI
held on the 3rd day of March , 1992 by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Larson, Stanton and NJ
