That certain agreement between the City of Carlsbad and the Palomar Community Col 7 11 District for paramedic training, attached hereto as Exhibit A, is hereby approved. 11 2. PmOSTi: OF m WITNESSETH: WHEREAS, the COLLEGE is hereby authorized to enter into thie agrement as permitted by California Education Code Section 78240, WHEREAS, the COLLEGE and EMT-P SERVXCE PROVIDER acknowledge z public obligation to contribute to the education of paramedics fol the benefit of the stuaents and for community needs, WHEREAS, the COLLEGE has established a program for traininc paramedics that requires the educational facilities of the EMT-I SERVXCE PROVIDER in field praatice, WHEREAS, the EHT-P SERVICE PROVIDER has field facilitiel suitable for the educational needs of the COLLEGE paramedit PrOgrm, WHEREAS, it is to the mutual benefit of both the COLLEGE an4 MT-P SERVICE PROVIDER that students have opportunities for fitilc service education as 6tUdentS and future practitioners. NOW, THEREFORE, the COLLEGE and the EMT-P SERVICE PROVIDE: mutually agree a8 folluwa: I. RESPONSIBILITIES AND PRIVILEGES OF THE COLLEGE A. For the Proararn in General, 1. The COLLEGE assumes full responsibility fo offering an educational program eligible fo accreditation by the State Department of Educatio and the San Diego County Division of Emerqenc Medical Services. 2. The COLLEGE will provide the same quality o education in the paramedic program as it does I all other curriculum offerings at the COLLEGE. 1 3. The word "faculty" as Used herein means the COLLEGE faculty engaged in teaching in the COLLEGE Paramedic Program. The words "student" nr "students" as used herein means students of the COLLEGE who ar enrolled in the COLLEGE Paramedic Frogran. 4. The COLLEGE will select and train preceptors in cooperation with the field service providers. B. - 1. The COLLEGE will provide the necessary faculty to plan and coordinate the field experience for paramedic students. Said faculty will assume responsibility for monitoring emt-p students while assigned to the E34T-P SERVICE PROVIDER. 2. The COLLEGE will develop a plan for using the EMT-P SERVICE PROVIDER'S facilities to meat the educational goals of. the curriculum. Thih: plan will include a list of the number of hours involved and shall be made available to the EMT-P SERVICE PROVIDER at a mUtUally agreed upon time prior to the beginning of the school term and Bubjact to revision by the MT-P SERVICE PROVTDER in instances where conflicts with tha EMT-P SERVICE PROVIDER seem to exist. 3. The COLLEGE will assume responsibility for determining the final grade evaluation relative to the students performance after coneultation with students file preceptor. 4. The faculty will be responsible €or learning and observing the policies and regulations of both COUEEE and EMT-P SERVICE PROVIDER as they apply to the circustances of the field teaching. 5. The COLLEGE is responsible to assure the students assigned to the EMT-P SERVICE PROVIDER for field internship meet both COLLEGE and EMT-P SERVICE PROVIDER standards of health and have the academic ability to profit from the experience. 6. The COLLEGE will require that all instructors and students during assignment ta the EMT-P SERVICE PROVIDER comply with the same administrative policies ac tha employees in matters relating to the welfare of the patiant. a W W 1 C. The m-P SERVICE PROVIDER will accept for f iel internship ernt-p studente in a number mutual1 agreed upon by the COLLEGE and MT-P SERVIC PROVIDER- 8. Facilities and SuuDliea 1. The EMT-P SERVICE PROVIDER will permit th educational use of such supplies and equipment a are commonly available for patient care. 2. The XWFP SERVICE PROVIDER will provide access t sources of information for educational purposes subject to the El4T-P SERVICE PROVIDER'S right t protect tne privacy of the patient: a. Procedures guides, policy manuals b. standard f leld references Such as meaice dictionary, diagnostic texts, phannacolo( references and standard references suitable 1 th8 field area and care program. Examples : 3 C. staff ParticiDation in Education 1. The EMT-P SERVICE PROVIDER will recommend staff to function as preceptors for paramedic students during the field internship. The ratio of preceptors to students shall not exaeed one to one. 2. Preceptore will attend a training session for the purpose of orienting them to the educational program and evaluation procedures. 3. prtccptota vi11 assist with the education and evaluation of paramedic students during the field internship. 4. Preceptors will remain employees of the EMT-P SERVICE PROVIDER and will not be considered employees of the COUEGE. D. R Privdeqeg .. 1, The FXT-B SBRVICE PROVIDER may refuse educational access to its field areas or records to any COLLEGE faculty or students who do not meet the EMT-P SERVICE PROVIDER'S standards. 2, The EHT-P SERVICE PROVIDER may resolve any problem situation in favor of the patient's welfare and may restrict the student involved. E. Statu8 of Students 1. Students will have the status of learners and will not replace EMT-P SERVICE PROVIDER staff, nor give service to patients apart from its educational value . 2. Students are subject to the authority, policies and regulations of the COLLEGE. They are also aubject, during field assignment and while with the EMT-P SERVICE PROVIDER, to the authority, policies and regulations of the EMT-P SERVICE PROVIDER. 3. Students will wear the designated uniform in field areas. 4 m T 0 F. Liabilitv Status of Contractina Aqsncies 1, The COLLEGE shall carry professional 1PabilitT ~- insurance (malpractice) covering students of th; COLLEGE during assignment with EMT-P SERVIC: PROVIDER. ~- insurance (malpractice) covering students of th; COLLEGE during assignment with EMT-P SERVIC: PROVIDER. 2. The COLLEGE shall carry public liability insurano covering faculty merabers of the COLLEGE durinl assignment with the EMT-P SERVICE PROVXDER. 3. The COLLEGE shall carry workers' compensatio insurance covering its faculty and students whil With the EHT-P SERVICE PROVXDER (pursuant to Lab0 Code Section 3368). 4. COLLEGE shall indemnify and hold harmless EMT- SERVICE PROVIDER from and against any and a1 liability arising from any negligent act, 0 COLLEGE'S students or instructors during the fie1 int'krnship. EMT-P SERVICE PROWIDEX shall indemnif and hold harmless COLLEGE from and against any an all liability arising from any negligent act 0 EHT-P SERVICE PROVIDER, its officer's, agents o employee8 . G. Duration of the Contract 1. This agreement is for B period of kine not t exceed three years but may be terminated at clos of any school year by serving notice in writing a the intention to do so by either party. 2. This contract shall be reviewed annually by th administrative staff of CCILLME and EMT-P SERVIC PROVIDER. 5 IN WITNESS WHEREOF, the said parties have hereunto set their hands on the date first above written.
