CASE NAME: RANCHO SANTA FE ROAD CASE NO: EIR 91-1 WHEREAS, on March 18, 1992 the Carlsbad Planning Commission held a duly noticed public hearing to consider an Environmental Impact Report (EIR 91-1) for a project to realign and construct Rancho Santa Fe Road to a six lane prime arterial standards from La Costa Avenue north to the existing'Melrose Avenue as described in the City of Carlsbad Rancho Santa Fe Road route adoption report alignment C-1 IICanyon Alignmenttt and the mass grading of land on both sides of the roadway in preparation for future development on a total of 448 acres within a 768 acre site. At the conclusion of the hearing the Commission adopted Resolution No. 3371 recommending to the City Council that EIR 91-1 be approved: and REALIGNMENT AND MASS GRADING WHEREAS, the City Council of the City of Carlsbad on May 19, 1992 held a duly noticed public hearing to consider the Commission's recommendations and heard all persons interested in or opposed to EIR 91-1; and WHEREAS, at said public hearing, the City Council also considered an "erratat1 sheet dated April 1, 1992 and an I'Addendum 1 1 2 3 4 5 6 7 8 9 10 11 12 !m iw8 iag '> !FZ 13 '$x i55 14 $3 zz 16 0% 15 $* 50 sr? zz 17 0 18 19 20 21 22 23 24 25 26 27 28 e 0 to Environmental Impact Report EIR 91-1", and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. The Environmental Impact Report EIR 91-1 is amended to include the comments and documents of those testifying at the public hearings and responses thereto, and found to be in good faith and reason by incorporating a copy of the minutes of said public hearings into the report. 3. That the Environmental Impact Report EIR 91-1, as so amended, including the Iverratavv sheet dated April 1, 1992 and the IvAddendum to Environmental Impact Report EIR 91-lv1, has been completed in compliance with CEQA. 4. That among the alternatives evaluated, the City Council finds that the project, as defined in the EIR and the staff report, which incorporates mitigation measures as discussed below, is approved for implementation. 5. Environmental Impact Report EIR 91-1, with the inclusion of the errata sheet and the addendum, shall be reviewed and considered by the appropriate City staff when issuing the permits associated with the project. 6. Exhibit A (mitigation measures) shall be incorporated into all approvals for the project. (See attached). 7. The mitigation measures will reduce biological impacts of the project to a level of insignificance. That the findings and conditions of the Planning Commission in Resolution No. 3371 on file with the City Clerk and incorporated herein by reference, recommending certification of the Environmental Impact Report EIR 91-1, except as modified herein, are the findings and conditions of the City Council in this matter with the addition of two conditions to read as follows: "Condition No. 3. If a Habitat Conservation Plan (HCP) is completed, including environmental review under the provisions of the California Environmental Quality Act and the National Environmental Protection Act, and approved by the City, United States Fish and Wildlife Service (FWS) and California Department of Fish and Game (DFG) prior to the implementation of the Mitigation Plan discussed above, the HCP may be implemented as an alternative Mitigation Plan. Such an alternative plan would also have the effect of reducing biological impacts to a level of insignificance. It IICondition No. 4. All interested parties are desirous of completing and implementing the HCP alternative. Therefore, grading permits shall not be issued for the project for a period of at least 60 days from Council certification of the EIR. An extension to this time period may be authorized by the Planning Director and City Engineer." 9. This action is final the date this resolution is adopted by the City Council. The provision of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial Reviewtv shall apply: "NOTICE TO APPLICANT" "The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. This in no way extends the statute of limitations contained in Public Resources Code Section 21167. A written request for the preparation of the record of the proceedings shall be filed with the City Clerk, City of Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, California 92008." EFFECTIVE DATE: This resolution shall be effective upon its adoption, except as to the General Plan Amendment, which shall be effective thirty (30) days following its adoption.
