A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING SURETY FUNDS AND
APPROVING FORMATION OF A CAPITAL IMPROVEMENT
PROJECT.

6 agreement for the project known as CT 81-19, Mar Y Montanas, Units 1 and 2;
WHEREAS, LCJ Development Corporation has defaulted on the subdivision impro!
7 WHEREAS, the City Council accepts funds in the amount of $1 62,555 from the Res
8 Trust Corporation acting as agent for City Federal Savings Bank, the surety;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Ca,
California, as follows:
1. That the above recitations are true and correct.
2. That the above funds are appropriated for formation of a capital impro\
project (CIP) to complete final punch list work not performed by the developer.
3. That the above funds may also be used for completion of final punch list itet
appropriate to include in the CIP.
