RESOLUTION NO. 93-103
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A QUITCLAIM DEED OF EASEMENTTO QUITCLAIM
UNIT B, AVIARA PHASE I; PR 3.7.44
A DRAINAGE EASEMENT WITHIN LOT 87 OF CARLSBAD TRACT NO. 85-35
WHEREAS, Aviara Resort Associates Limited Partnership has submitted a reql
quitclaiming by the City of a drainage easement within Lot 87 of Carlsbad Tract No. 85-
8, Aviara Phase I, dedicated to the City of Carlsbad on the final map of said Carlsbac
per Map No. 12410, filed in the office of the County Recorder of San Diego County; a
WHEREAS, said drainage easement was never utilized for the purpose for whict
granted, nor is it contemplated to be needed for the purpose of a drainage easement
WHEREAS, the City Council of the City of Carlsbad has determined it to be
public interest to quitclaim said drainage easement.
NOW, THEREFORE, be it resolved by the City Council of the City of Carlsbad, Ca
as follows:
1. That the above recitations are true and correct.
2. That the City Council of the City of Carlsbad quitclaims said drainage ea!
within Lot 87 of Carlsbad Tract No. 85-35 Unit B, Aviara Phase I, and authorizes the M
execute a Quitclaim Deed to that effect.
