RESOLUTION NO. 93-110
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN AMENDMENT TO THE CARLSBAD MELLO I1 LOCAL COASTAL PROGRAM TO BRING THE DESIGNATIONS ON THE LOCAL COASTAL PROGRAM, GENERAL PLAN, AND ZONING MAP INTO
CONFORMANCE ON PROPERTIES GENERALLY LOCATED IN THE SOUTHERN PORTION OF THE CITY'S BEACH AREA OVERLAY ZONE IN THE CITY OF CARLSBAD. CASE NAME: BEACH AREA LAND USE STUDY

7 WHEREAS, California State Law requires that the 1

in the Coastal Zone be in conformance: 9
Coastal Plan, General Plan, and zoning designations for propel
10 WHEREAS, a verified application for an amendment tc
11 Local Coastal Plan designations for certain property locate(
12 shown on Exhibits "A-C1', dated February 3, 1993, attache
13 Planning Commission Resolution No. 3442 and incorporate
14 reference, has been filed with the City Council: and
15 WHEREAS, saidverified application constitutes a rec
16 for amendment as provided in Title 21 of the Carlsbad Munic
17 Code: and

WHEREAS, the City Council did on the 20th day
APRIL , 1993, hold a duly noticed public hearin
21 I/ Amendments shown on Exhibit "A-C" , and:
22 WHEREAS, at said public hearing, upon hearing

considering all testimony and arguments, if any, of all pe
desiring to be heard, said Council considered all factors re1
25 I1 to the Local Coastal Plan Amendment.

WHEREAS, State Coastal Guidelines requires a six
public review period for any amendment to the Local co

NOW, THEREFORE, BE IT HEREBY RESOLVED by the

6 C) That based on the evidence presented at the pu
7 hearing, the Council APPROVES LCPA 92-02 as shown on Exhibit
8 Cww , dated February 3 , 1993, attached to Planning Commis
9 Resolution No. 3442 and made a part hereof based on the folla
10 findings :
11 Findinss:
12 1. The proposed Local Coastal Program Amendment is consis
13 with all applicable policies of the Mello I1 Local Coa
14 2. The proposed amendment to the Mello I1 segment of
15 Carlsbad Local Coastal Program is required to bring designations of the Local Coastal Program, General Plan
16 Zoning for the study area into conformance.
