RESOLUTION NO. 93-122
i A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA REIMBURSING TRAFFIC IMPACT
FEES TO JOHNSON COMPANY WAX DEVELOPMENT
WHEREAS, the City Council of the City of Carlsbad, California on October 1
5 11 adopted the Traffic Impact Fee program authorizing the collection of fees to fund \

circulation facilities within the City: and
WHEREAS, the City Council of the City of Carlsbad, California on October 1
adopted Resolution No. 91 -326 approving a list of circulation facilities which are to be 1
through the collection of Traffic Impact Fees and included the intersection of El Camir
and Alga Road; and

WHEREAS, the Johnson Wax Development Company received approval 1 14
intersection improvements at El Camino Real and Alga Road at $250,000; and
WHEREAS, the Johnson Wax Development Company completed the rc 18
Road intersection; and I”7
intersection improvements including traffic signal modifications at El Camino Real an 16
Development Plan No. 86-1 1 (A) which contained a condition requiring the construc 15
WHEREAS, Resolution No. 91-326 established the estimated costs associate
I’ 11 intersection improvements in accordance with the approved street improvement plan:

WHEREAS, Traffic Impact Fees were assessed in conjunction with the issu:
ll building permits for the shell buildings constructed by Johnson Wax Developmenl

25 ;I WHEREAS, it is necessary to adjust the Traffic Impact Fees with respect to thc

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cc 28

Alga Road exceed the required Traffic Impact Fees associated with the Plaza Pase
Shopping Center. A reimbursable amount of $29,338 should be refunded to Johnsc
Development Company due to the extent of the cost for constructing the required inter:
improvements.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsb,
Council held on the 4th day of MAY , 1993 by the following vote, to wit:
