HomeMy WebLinkAbout1993-07-06; City Council; Resolution 93-197/I e 0 1 2 3 4 5 6 7 RESOLUTION NO. 93-197 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD CALIFORNIA DIRECTING CITY STAFF TO DEVELOP AN ALTERNATE FINANCING PLAN FOR RANCHO SANTA FE ROAD AND OLlVENHAlF ROAD AND TO REVISE THE LOCAL FACILITIES MANAGEMENT PIAN! FOR ZONES 11 AND 12. WHEREAS, the City Council of the City of Carlsbad has determine( 8 various sections of Rancho Santa Fe Road and Olivenhain Road, herein referrel 9 that it is in the public interest to provide for the financing of the construction c lo to as the Project; and 11 12 13 14 15 WHEREAS, financing for the Project is identified in the Local Facilitie WHEREAS, the construction of these road segments is important t the creation of a circulation system that will serve the ultimate needs of the citizen of the City of Carlsbad; and 16 Council has considered the need to create a financing program for the Project th: I? Management Plan for Zones 11 and 12 as a developer responsibility, and the Cii l8 11 is both reasonable and achievable for the City and the property owners charge 19 I with providing funding for this project; and 20 21 I1 WHEREAS, the City Council recognizes that it is not necessary 1 22 entire Project is guaranteed to the satisfaction of the City Council; and 24 goal of providing a high quality circulation system, provided that financing for tt- 23 construct all portions of The Project in a single phase to accomplish the City 25 ~ I construction of the Project can best meet the needs of the City and the proper 26 WHEREAS, the creation of a Community Facilities District to fund tt- 27 II 28 j/ owners by providing flexibility in timing of construction of the improvements; ar 1 2 0 0 WHEREAS, California Pacific Homes, owner of Tentative Tract Ma 3 CT 85-9, and the San Dieguito Union High School District have entered into 4 contractual agreement providing for their joint development of certain publi 5 improvements necessary for construction of the South Carlsbad High School o f5 7 a site adjacent to CT 85-9; and WHEREAS, in order for California Pacific Homes to fulfill il 8 9 obligations under the agreement with San Dieguito Union High School District, 10 I( will be necessary for California Pacific Homes to obtain City Council approval ( 11 a final map for CT 85-9, in compliance with all conditions of approval placed c 12 the map and contained in the Local Facilities Management Plan for Zone 1 13 including the Zone 11/12 Financing Plan; and 14 15 16 WHEREAS, the City Council recognizes that there is a substanti public benefit to the San Dieguito Union High School District and the residents ( 17 !I Carlsbad created by providing an alternate financing program for Rancho Sani 18 19 of their project; and Fe Road and allowing California Pacific Homes to proceed with the developmel 2o I WHEREAS, the City Council wishes to provide for an interim fc 21 22 23 24 25 26 27 program which would constitute an interim financial guarantee for the Proje pursuant to Growth Management to allow approved tentative maps to be finalk and building permits to be issued while steps are being taken to form the CFI NOW,THEREFORE, BE IT RESOLVED by the City Council of the Ci of Carlsbad, California, as follows: I 28 1. That the City staff is hereby directed to proceed with th creation of documents to form a Community Facilities Distric (CFD) consistent with City Council Policy No. 38 to financ the construction of the Project. 3. That the City staff is hereby directed to proceed with tt- creation of documents to establish an interim fee progran including related agreements and waivers as deeme necessary and appropriate by the City Attorney, to financ the Project in advance of formation of the CFD. Such fc program shall not, in and of itself, be deemed to provide sufficient long-term guarantee for construction of tt- improvements pursuant to Growth Management. Tk execution of agreements to participate in, and ultimate1 actual formation of and participation in the CFD financir program will be required to meet Growth Manageme, standards. However, the interim fee program and relate agreements and waivers shall constitute an adequate interi guarantee to allow approved tentative maps to be finalk and building permits to be issued while formation of the CF is proceeding. 4. That the Staff is hereby directed to revise the appropria sections of the Zone 11/12 Financing Plan to be consiste with this action, and to present these revisions to the Ci Council for approval. I1 e e + 1 2 3 5. That the amount of $30,000 is hereby appropriated from th General Fund Balance to the Rancho Santa F 4 Road/Olivenhain Road Project Account to fund preliminar 5 program. These costs are to be repaid to the General Fun 6 costs related to the creation of the CFD and the interim fe 7 8 9 10 from fee or CFD revenues.
