RESOLUTION NO. 93-200
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, ESTABLISHING
PARKING PENALTIES
WHEREAS, the City of Carlsbad enforces parking violations
through the authority of the California Vehicle Code and the Carlsbad
Municipal Code; and
WHEREAS, effective July 1, 1993, Vehicle Code Section
40203.5(a) was amended such that the governing body of the jurisdiction
where the notice of violation is issued shall establish penalties, fees and other
charges for parking violations; and
WHEREAS, the City Council is the governing body of the City of
Carlsbad; and
WHEREAS, Carlsbad Municipal Code Subsection 10.42.010(b)
allows parking penalties to be set by Council resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Carlsbad, California, as follows:
1. That parking violation penalties shall remain as established
by the court for bail, penalties, and assessments pursuant to prior State law
as shown in the 1993 San Diego County Misdemeanor Bail Schedule.
2. To the extent that it does not deprive anyone of a
constitutional right, the penalties are retroactive to July 1, 1993.

3. This resolution shall become effective on the effective date
of Ordinance No. NS-248 .
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council on the 6th day of JULY , 1993, by the following vote,
to wit:
AYES: Council Members Lewis, Stanton, Kulchin, Nygaard,
NOES: None
ABSENT: None
