HomeMy WebLinkAbout1993-10-05; City Council; Resolution 93-2880 0 1 2 3 4 5 6 RESOLUTION NO. 93-288 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA OPPOSING THE PROPOSED EXPANSION OF THE AIRPORT INFLUENCE AREA BOUNDARY OF THE DRAFT COMPREHENSIVE LAND USE PLAN (CLUP) FOR MCCLELLAN- PALOMAR AIRPORT AND RECOMMENDING MODIFICATIONS TO THE CLUP INCLUDING CHANGES TO THE AVIGATION EASEMENT POLICY; CHANGES TO THE AIRPORT NOISE/LAND USE COMPATIBILITY MATRIX; AND, CHANGES TO THE CLUP TEXT REGARDING CITY POLICY ON CITY DESIGNATED SPECIAL TREATMENT AREAS. 7 WHEREAS, the Comprehensive Land Use Plan (CLUP) 8 Commission (ALUC) Staff; and 9 HcClellan-Palomar Airport has been updated by the Airport Land 10 WHEREAS, the formal review period for the draft 11 began on August 23, 1993 and closes on October 7, 1993; and 12 WHEREAS, the City Council of the City of Carlsbad 13 authority of the ALUC; and 19 WHEREAS, the Airport Influence Area is the are; 18 consistent with the Comprehensive Land Use Plan; and 1'7 Section 21676, the Carlsbad General Plan is required tc 16 WHEREAS, pursuant to California Public Utility 15 WHEREAS, the City is empowered to control land use; 14 reviewed the proposed CLUP for McClellan-Palomar Airport: an 20 WHEREAS, the ALUC may adopt regulatory controls wi 21 their area of authority; and 22 WHEREAS, the updated CLUP includes an expansion of 23 on the Airport Noise/Land Use Compatibility Matrix; and 26 avigation easements for projects deemed ''conditionally compati 25 WHEREAS, the updated CLUP requires the City to ok 24 Airport Influence Area boundary; and 27 WHEREAS, the updated CLUP only permits golf course 28 in areas impacted by noise levels up to 70 dBA CNEL; and li 0 I1 1 I/ WHEREAS, the CLUP reflects an old City Policy regarc 2 ll Special Treatment Area Regulations around the airport; and 3 I/ WHEREAS, the City Council has several concerns with 4 ll draft CLUP dated March 1993. 5 I/ NOW, THEREFORE, BE IT RESOLVED by the City Council of City of Carlsbad as follows: 6 7 8 9 10 1. The City Council opposes the proposed expansio the Airport Influence Area to the three mile radius around airport plus the take-off and landing tracks to the north and as presented in the draft CLUP dated March 1993, and recomm 11 /pat the Airport Influence Area boundary only be enla 12 /Islightly to the north to encompass the new future (1995) air 13 I noise contours (see Exhibit vlXgg). 2. That the CLUP establish an official procedur notify new property owners of their proximity to the airport that they may be subject to aircraft overflight from the AirF This notification procedure should cover the three mile ra around the airport plus the take-off and landing tracks to north and east. 14 15 16 17 18 19 i 20 ~ 3. That the CLUP be revised to reflect current 7 8 9 policy with respect to Special Treatment Areas around the airp, The new City policy would require that within the Air Influence Area all proposed projects comply with the n 10 11 12 13 14 15 16 standards of the CLUP and meet Federal Aviation Administra (FAA) requirements with respect to building height and provision of obstruction lighting when the FAA permits portior structures to penetrate the transitional surface (a 7 to 1 s from the runway primary surface). PASSED, APPROVED AND ADOPTED at a regular meeting of City Council of the City of Carlsbad on the 5th day of I? il October , 1993, by the following vote, to wit: 19 l8 I.
