A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAF
CALIFORNIA, APPROVING AN AGREEMENT WITH NCTD REGARDINC
BATlQUlTOS LAGOON ENHANCEMENT PROJECT
WHEREAS, the City Council of the City of Carlsbad, California, has p
6 entered into agreements with the City of Los Angeles, acting by and through
7 of Harbor Commissioners, regarding the Batiquitos Lagoon Enhancement Pro
8 WHEREAS, said project shall affect facilities within right-of-way ow
9 operated by the North San Diego County Transit Development Board, hl
lo /I referred to as "NCTD"; and

12 WHEREAS, City and NCTD desire to enter an agreement for the re
13 /I analysis of construction plans for said project and effects, if any, upon facilitil
14

presented; and l6
WHEREAS, said City-NCTD agreement has been prepared and i 15
and operated by NCTD; and
WHEREAS, the NCTD Board did previously approve said agreement or
l8 11 14, 1993; and 19 I
WHEREAS, the City Council of the City of Carlsbad, California, herel 20
21 necessary, desirable, and in the public interest to approve said agreement w

NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of

1. That the above recitations are true and correct.
2. That an agreement between the City of Carlsbad and NCTD
work associated with the aforementioned project is hereby approved and the I
28 City Clerk are hereby authorized and directed to execute said agreement. Foll
