A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBA:
CALIFORNIA APPROVING AN AMENDMENT TO THE FINANCING PLAN F(
LOCAL FACILITIES MANAGEMENT ZONES 11 AND 12.

12 Road, Olivenhain Road, and other related minor infrastructure improvements, and
13 WHEREAS, the City in cooperation with the property owners in Zones 11 and 12
14 determined that a Community Facilities District (CFD) is the preferred financing mechanism
15 an Assessment District for these facilities, and
16 WHEREAS, the City and the property owners in Zones 11 and 12 wish to amend the
17 adopted Financing Plan to allow use of a CFD as a flnancing mechanism, and

WHEREAS, pursuant to the Growth Management Program, the City of Carlsbad has r(
property owners within Local Facilities Management Zones 11 and 12 to prepare a Financir
public facilities that are necessary to serve development in those zones, and
WHEREAS, the primary public facilities needed to serve development in Zones 11
portions of Rancho Santa Fe Road and Olivenhain Road, and
WHEREAS, on May 19, 1992, the City Council approved a Financing Plan for Zones
which called for the formation of an Assessment District to finance the construction of Ranch
WHEREAS, the City Council finds that use of a CFD for the stated facilities meets the
I a financial guarantee as required by the Growth Management Program.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
as follows:
1. That the above recitations are true and correct.
2. That the Zone 11/12 Financing Plan is hereby amended to replace all re
"Assessment District" with references to "Assessment District, Community Facilities Distri
financing program acceptahle to the City Councii."
