RESOLUTION NO. 94-28
ACCEPTING A DEED AND AUTHORIZING THE CITY CLERK TO ACCEPT F1
DEEDS IN LIEU OF CONDEMNATION FOR THE BATIQUITOS LA
ENHANCEMENT PROJECT.
WHEREAS, the City Council of the City of Carlsbad, California, on Janu

City limits required for the Batiquitos Lagoon Enhancement Project; and 7
1994 adopted the Resolution of Necessity to Condemn certain properties witk
8 WHEREAS, one of the property owners has accepted the City’s offer to pu

the property in lieu of proceeding with the condemnation and has executed a
deed to the City; and
12 I/ WHEREAS, the City Council hereby finds it necessary, desirable, and
13 public interest to accept this aforementioned deed and future deeds, if any, requi I/ 14

NOW, THEREFORE, BE IT RESOLVED, by the City Council, of the ( 15
said project.
1. That the above recitations are true and correct.

19 2. That a grant deed from Constance Sammis and John Lamb reg
20 property acquisition for the Batiquitos Lagoon Enhancement Project is hereby ac
21 and the Mayor and City Clerk are authorized to execute said grant deed. The Cit
22 is further authorized and directed to forward the original, executed copy of saic

deeds shall be returned by the City Clerk to City's Special Counsel at the
referenced address.
PASSED, APPROVED AND ADOPTED at the regular meeting of the Carlsb
Council held on the 18th day of JANUARY , 1994,
following vote, to wit:
