I 3 WHEREAS, the conditions which exist on Assessor’s Parcel Number 204-1 1 * 5 00 are alleged constitute a public nuisance as defined in Title 6, Section 6.16.C 6 the Carlsbad Municipal Code; and Sections 202 and 302 of the Uniform Code f 7 Abatement of Dangerous Buildings, as adopted by the Carlsbad Municipal Code i 8 9 18, Section 18.19.01 0. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Car 10 California, as follows: 11 1. That the above recitations are true and correct. l2 // 2. That the City has the power at both common law and by ordinar 13 14 abate nuisances. 15 /I 3. That the City Council has established procedures for the abatemc I€i It certain nuisances within the City limits. 17 19 1994 in the City Council Chambers at 1200 Carlsbad Village Drive, Carlsbad, Calif 18 4. That the City Council will hold a public hearing on March 22 to consider whether or not the conditions on the property constitute a public nui: 20 and will hear and consider any and all evidence and objections. 21 22 5. That if a public nuisance is found to exist it will be ordered abated a 23 expense of the property owner(s) or the persons causing or maintaining the nuis 24 and such expense shall become a lien and special assessment against the properti 25 26 a personal obligation of the property owner and the persons creating, cau committing or maintaining the public nuisance. 27 .... 28 r.
