HomeMy WebLinkAbout1994-05-03; City Council; Resolution 94-123r ll 0 0 II k 1 2 3 4 5 6 7 8 9 10 11 0 sug ALL, s::$ ~I-q 9 OOLL I a- a>m$ OZLO E~zn !=OW 00s a01 >2lq 60 Y2- KEA an8 OWE ZWLO 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 94-123 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A NEGATIVE GENERALLY LOCATED EAST OF THE FUTURE INTERSECTION OF THE EXTENSION OF COLLEGE AVENUE AND CANNON ROAD NORTHEAST OF EL CAMINO REAL IN LOCAL FACILITIES MANAGEMENT ZONES 15 APPLICANT: KELLY DEL CERRO CASE NO: ZC 93-06 WHEREAS, on February 16, 1994 the Carlsbad Plann Commission held a duly noticed public hearing to considel proposed Negative Declaration and Zone Change (ZC 93-06) f Residential Agriculture R-A-10 to Limited Control L-C for 246 ac of land and adopted Resolutions Nos. 3624 and 3625, respective recommending to the City Council that they be approved; and DEC-TION FOR A ZONE CHANGE AND FOR PROPERTY WHEREAS, the City Council of the City of Carlsbad, April 26, 1994 held a public hearing to . consider recommendations and heard all persons interested in or opposed ZC 93-06 and WHEREAS, a Negative Declaration was issued on January 1994 and submitted to the State Clearinghouse for a 30 day rev period. All comments. received from that review period are fu incorporated into the conditions of approval for the specific p and other project approvals and these conditions will be revie through a monitoring program set up for the project, NOW, THEREFORE, BE IT RESOLVED by the City Council of City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Planning Commission recommendation of Zone Change (ZC 93-06) for this project is approved and that findings and conditions of the Planning Commission contained Resolution No. 3625, on file with the City Clerk and incorpora herein by reference, are the findings and conditions of the C Council. 4. This action is final the date this resolution adopted by the City Council. The provision of Chapter 1.16 of Carlsbad Municipal Code, IITime Limits for Judicial Review" sh apply: "NOTICE TO APPLICANT" !'The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which, has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final: however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one.
