HomeMy WebLinkAbout1994-06-21; City Council; Resolution 94-168II 0 0 .I I/ RESOLUTION NO. 94-168 1 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIF0 AUTHORIZING SUBMISSION OF THE FIELDSTONE/RANCHO SANTA FE ROAD HAE CONSERVATION PLAN. WHEREAS, the City Council of the City of Carlsbad did on the 21 st day of Jm 4 5 6 7 8 9 , 1994, received a staff report and recommendations regarding the Fieldstone/ Ra Santa Fe Road Habitat Conservation Plan (HCP), Implementation Agreement, and re documents; and WHEREAS, the staff report recommends that the HCP and Preliminary Draft Environm Assessment be accepted as written; and Io ll WHEREAS, the staff report recommends that the Implementation Agreement be accepl I1 12 WHEREAS, the staff report recommends that the HCP, Implementation Agreement 13 related documents be submitted to the United States Fish and Wildlife Service and Calif1 14 Department of Fish and Game for processing and ultimate approval, including issuance of pe 15 to take protected species of plants and animals; and 16 18 appropriate for the documents to be submitted at this time; and 17 WHEREAS, the City Council concurs with the staff recommendations and finds that WHEREAS, the City Council also finds it appropriate that the City of Carlsbad be : concept, subject to further negotiation; and I' 'I applicant along with the Fieldstone Company in the application for federal and state pel I1 20 I 21 22 23 24 25 26 because the HCP when approved will provide the wildlife habitat mitigation for the impsc construction of Rancho Santa Fe Road; and WHEREAS, in approving the staff recommendation the City Council acknowledges tha HCP, Implementation Agreement and related documents are in draft form, that the document subject to change, and that formal approval is contingent upon completion of a numbe additional steps which must be taken by the City and other agencies; and 27 I1 WHEREAS, notwithstanding the draft nature of the documents, the City Council autho 28 their submission with the understanding that said documents are intended to satisfy and be 7 ll v 0 r a in compliance with applicable state and federal regulations regarding the treatment of enda and threatened species. 1 2 3 NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Ca California as follows: 4 5 1. That the above recitations are true and correct. 2. That the Mayor is authorized to sign the application form for a federal Inc Take Permit. 6 3. That staff is authorized to submit the complete package of documents as an 7 a to the United States Fish and Wildlife Service and California Department of Fj Game.
