HomeMy WebLinkAbout1994-06-28; City Council; Resolution 94-171-. , v. 0 0 Exhibit 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 94-171 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES STATEMENTS SUBMITTED TO THE VOTERS AT AN ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 1994. WHEREAS, Section 10012 of the Elections Code of the State of Califo provides that the governing body of any local agency adopt regulations pertai to materi a1 s prepared by any candidate for a municipal election, incl uding c of the candi.dates statements; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. GENERAL PROVISIONS. That pursuant to Section 10012 of Elections Code of the State of California, each candidate for elective offic be voted for at an election to be held in the City of Carl sbad on Novembe 1994, may prepare a candidate’s statement on an appropriate form provided by City Clerk. The statement may include the name, age and occupation of candidate and a brief description of no more than two hundred (200) words of candidate’s education and qualifications expressed by the candidate himsel herself. The statement shall not include any party affiliation of the candid nor membership or activity in partisan political organizations. The state shall be filed in the Office of the City Clerk at the time the candida nomination papers are filed. The statement may be withdrawn, but not chan during the period for filing nomination papers and until 5:OO p.m. of the working day after the close of the nomination period. SECTION 2. SPANISH LANGUAGE. Pursuant to the Voting Rights Act, candidates statements shall also be translated into Spanish. SECTION 3. ADDITIONAL MATERIALS. PAYMENT. Each candidate filing a candidate’s statement SI be billed for the services rendered a sum not greater than his or her ac. prorata share of costs for printing, handling, mailing the candida. statements, and for the actual cost of the Spanish trans1 ation. Such bill SI be due and payable immediately upon receipt thereof. SECTION 5. Each candidate shall pay a $25.00 fee at the time nomination papers are filed with the City Clerk. In lieu of the $25.00 fi- fee, candidates may process a petition-in-lieu by acquiring four signatures each $1.00 of the filing fee. A total of 100 signatures of registered voter: the City shall replace the $25.00 filing fee. Petitions-in-lieu must submitted to the City Clerk’s Office no later than July 28, 1994. SECTION 6. That the City Clerk shall provide each candidate, or candidate’s representative, a copy of this resolution at the time nominat petitions are issued. SECTION 7. That this resolution shall apply only to the election tc held on November 8, 1994, and shall then be repealed.
