II 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 RESOLUTION NO. 9 4 - 17 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CAIXLSBAD, CALIFORNIA, APPROVING A CASH COMPENSATION PAYMENT FOR EMPLOYEES REPRESENTED BY THE CARLSBAD FIREFIGHTERS’ ASSOCLATION. WHEREAS, the Council did on May 11, 1993, by Resolution No. 93-133, approve the Memorandum of Understanding (MOU) between Management and representatives of the Carlsbad Firefighters’ Association (CFA), which called for the parties to meet and confer on the subject of a salary adjustment: and WHEREAS, because of current economic conditions both at the city and state level, it has been mutually agreed that no adjustment to the salary schedule or individual salaries will be made at this time: and WHEREAS, the City Council has determined that it is appropriate to grant each employee represented by the Carlsbad Firefighters’ Association a cash compensation payment in the amount of one thousand two hundred dollars ($1,200) on or before July 1, 1994: and WHEREAS, the City has met and conferred with the Carlsbad Firefighters’ Association regarding this change as noted in Attachment A, attached hereto and made a part thereof; and WHEREAS, the cost of this cash compensation payment will be funded from the General Fund balance. /// /// i > 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Carlsbad, California, as follows: I. That the above recitations are true and correct. 2. That the recommendation that the City grant a cash compensation payment for performing normally required duties performed on regular work shifts as defined in Government Code Section 20022(a)(8), in the amount of one thousand two hundred dollars ($1,200) paid to all employees represented by the Carlsbad Firefighters’ Association who are employed on June 28, 1994, is hereby approved. Such cash compensation payment will be treated as a part of salary and, as such, will be subject to all withholdings as required by law. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 28th day of JUNE , 1994, by the following vote, to wit: AYES: Council Members Stanton, Kulchin, Nygaard, Finnila NOES: None r7 ABSENT: Council Member Lewis MARGAY] STANTON, Mayor Pro Tem ATTEST: ALETHA L. (SEAL) 28 4 L 0 0 ATTACHMENT A AGREEMENT WITH THE CARLSBAD FIREFIGHTERS’ ASSOCIATION Article 8 of the current Memorandum of Understanding (MOU) states that the parties “will meet and confer on the subject of a salary adjustment beginning December 1993. Upon mutual agreement, the parties may reopen discussions at either an earlier or a later date. The effective date of the adjustment will be a subject of meeting and conferring.,’ In December 1993, both parties agreed ,to postpone reopening discussions on the subject of a salary adjustment until May of 1994. It has been mutually agreed that no adjustment to the salary schedule or individual salaries will be made at this time. However, the parties have agreed that each full time employee represented by the Carlsbad Firefighters’ Association will receive a one time cash compensation payment in the amount of one thousand two hundred dollars ($1200), to be paid by separate check on or before July 1, 1994. Such cash compensation payment will be treated as a part of salary and, as such, will be subject to all withholdings as required by law. Furthermore, the parties agree that this cash payment does not in any way limit the scope of options that may be negotiated between the parties in future negotiations. Except as expressly stated here, the terms and conditions of employment contained in the Memorandum of Understanding dated January 1, 1993 shall continue in effect until the expiration of the MOU on December 3’4, 1994. 6 bo /w Dated / For the ‘.
