CASE NAME: SHORELINE PRESERVATION STRATEGY OBJECTIVES CASE NO: LCPA 93-05 WHEREAS, the Planning Commission did on May 4, 1994 ho a duly noticed public hearing as prescribed by law to consider Negative Declaration for Local Coastal Program LCPA 93-05 a adopted Planning Commission Resolution No. 3638, recommending the City Council that they be approved: and WHEREAS, the Planning Commission has determined th LCPA 93-05 will not have a significant impact on the environme and the City Council has concurred and a Negative Declaration w issued and approved in satisfaction of the requirements of t City of Carlsbad Environmental Protection Ordinance of 1980 a the California Environmental Quality Act; and WHEREAS, the City Council did on the 28th day JUNE , 1994, hold a duly noticed public hearing prescribed by law to consider the proposed Negative Declaratio and WHEREAS, at said public hearing, upon hearing a considering all testimony and arguments, if any, of all perso desiring to be heard, the City Council considered all facto relating to the Negative Declaration. NOW, THEREFORE, BE IT RESOLVED by the City Council the City of Carlsbad as follows: 1. That the findings and conditions of the Planni Commission in Resolution No. 3638 constitute the findings of t City Council in this matter. 3. That the Negative Declaration is approved as shc in Planning Commission Resolution No. 3638 on file with the Ci Clerk and incorporated herein by reference. 4. This action is final the date this resolution adopted by the City Council. The provisions of Chapter 1.16 the Carlsbad Municipal Code, "Time Limits for Judicial Revie shall apply: "NOTICE TO APPLICANT" The time within which judicial review of this decisi must be sought is governed by Code of Civil Procedur Section 1094.6, which has been made applicable in t City of Carlsbad by Carlsbad Municipal Code Chapt 1.16. Any petition or other paper seeking judici review must be filed in the appropriate court not lat that the nineteenth day following the date on which th decision becomes final; however, if within ten da after the decision becomes final a request for t record of the deposit in an amount sufficient by t required deposit in an amount sufficient to cover t estimated cost of preparation of such record, the ti within which such petition may be filed in court extended to not later than the thirtieth day followi the date on which the record is either personal delivered or mailed to the party, or his attorney record, if he has one. A written request for t preparation of the record of the proceedings shall filed with the City Clerk, City of Carlsbad, 12 Carlsbad Village Drive, Carlsbad, California 92008.11 ...
