LEWIS, Mayor AlTEST: - # (SEAL) 15 16 17 18 19 20 21 22 23 24 25 26 27 28 &’ L- 0 0 AMENDMENT NO. 2 TO AGREEMENT FOR ADDITIONAL DESIGN SERVICES FOR THE LA COSTA AVENUE/I-5 INTERCHANGE PROJECT THIS AMENDMENT NO. 2, made and entered into as of the 18th day of JULY , 1994, by and between the CITY OF CARLSBAD, a municipal corporation, hereinafter referred to as "CITY, and BOYLE ENGINEERING CORPORATION, hereinafter referred to as "CONSULTANT." RECITALS WHEREAS, CONSULTANT and CITY entered into an agreement on July 14, 1992, to provide engineering services for the La Costa Avenue/l-ti Interchange Project, hereinafter referred to as the "PROJECT"; and WHEREAS, said agreement identified a scope of work including the preparation of plans, specifications, contract documents, and cost estimates for the PROJECT; and WHEREAS, the parties to this aforementioned agreement desire to expand the scope of work to include additional environmental studies for performing archaeological testing of the site; and WHEREAS, CONSULTANT possesses the necessary skills, experience, professional expertise, financial abilities, and other qualifications to provide said services required by CITY; and WHEREAS, a supplemental scope of work and fee schedule have been negotiated and agreed to between the parties hereto, and as-shown on Exhibit "A Scope of Services; and WHEREAS, the City of Carlsbad, California, hereby finds it necessary, desirable, and in the public interest to proceed with this Amendment No. 2 for said additional work. 1 0 0 NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, CITY and CONSULTANT hereby agree as follows: 1. CONSULTANT shall provide services as outlined on the attached Exhibit "A". 2. CITY shall pay CONSULTANT for all work associated with Paragraph 1 above, on a time and materials basis not-to-exceed $18,504. CONSULTANT shall provide CITY .on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by CITY. 3. All provisions of the aforementioned agreement entered into on July 14, 1992, by and between CITY and CONSULTANT shall remain in full force and effect. 4. This Amendment No. 2 to the aforementioned agreement between CITY and CONSULTANT shall be effective on and from the day first above written. Assista~t Lit; 2 0 0 EXH I BIT "A I-5/LA COSTA AVENUE INTERCHANGE SCOPE OF SERVICES AMENDMENT NO. 2 SCOPE OF WORK Task 1: Delineation of the Area of Potential Effects (APE) and Completion of the Archaeological Survey Report (ASR) The APE will be delineated in consultation with the City. This will require meetings to review construction plans and possibly a field visit to assess potential impacts. The APE, which must be approved by Caltrans, will include areas of direct ground disturbance and any buffer areas necessary to effect avoidance. The draft APE map (on 1 :lo0 scale project base maps) will be included in the draft ASR, in accordance with Caltrans' standards. The ASR will provide the results of the literature review, records search, and archaeological survey, all of which have already been completed as part of Amendment No. 1. Under Caltrans' guidelines, a positive.ASR is required when archaeological sites are within or immediately adjacent to the APE. Portions of two previously recorded sites may be impacted by the proposed interchange widening at La Costa Avenue: CA-SDI-603 on the western side of the freeway, and CA-SDI-12,130 on the eastern side. As discussed below, an Extended Phase I investigation will be necessary at these sites to determine whether they will be affected. The results of the Extended Phase I will be included in the ASR. Task 2: Extended Phase I Investigation Under Caltrans' guidelines, Extended Phase I investigations are used to determine whether a subsurface deposit is present in the APE. If such deposits are present and cannot be avoided, a Phase II investigation is usually required in order to assess the significance of the site relative to the National Register criteria. . Both of the archaeological sites in the La Costa Avenue Interchange project have been impacted by previous construction activities. This makes it impossible to determine the presence or absence of potentially significant subsurface deposits by surface investigation alone. Accordingly, the primary goal of the Extended Phase I investigation will be to sample the subsurface components of each site to determine whether cultural materials maintain integrity. If subsurface materials are found to be secondary deposits resulting from previous construction activities, they are unlikely to qualify as a significant resource, and a Phase II investigation would not be warranted. On the other hand, if subsurface deposits are found which appear to remain in their primary context (i.e., have not been moved or severely disrupted by previous construction), a Phase I1 investigation would probably be necessary. This scope does not include a Phase I1 investigation. At CA-SDI-603, two questions must be addressed by the Extended Phase I1 investigation: 1. Is the cultural material observed along the face of the cut-bank above the southbound on-ramp between Stations 1683+30 and 1688+30 truly a secondary deposit as we currently believe? 1 0 0 2. Will construction along La Costa Avenue between Stations 1683+20 and 1685+50 affect cultural deposits which retain integrity? A shell and artifact scatter was observed on both sides of the street, but there was evidence that the upper portion of the cultural deposit had been removed during previous construction. It is uncertain whether existing material in the APE retains sufficient integrity to be of archaeological value. The field investigation at this site will include approximately 18 shovel test pits in the APE where cultural material was observed on the surface. It is anticipated that the shovel test pits will be deployed as follows: 1. Cut-bank along the southbound on-ramp: This area is about 500 feet in length. Five shovel test pits are planned, spaced at approximately equal intervals. 2. North side of La Costa Avenue: This area is approximately 200 feet in length. Four shovel test pits are planned, to be placed at approximately equal intervals. 3. South side of La Costa Avenue: This area is approximately 250 feet in length. Five shovel test pits are planned, to be placed at approximately equal intervals. If potentially intact cultural deposits are found during the course of shovel testing, 1 x 2 meter controlled text units could be used to better examine the integrity of the deposit. Since test units are viewed as a contingency, they are not included in this scope. At site CA-SDI-12,130 on the east side of the freeway, the Extended Phase I investigation will inciude ten shovel test pits between Stations 1665+00 and 1688+00. These will be placed between the existing right-of-way fence and the edge of the existing 1-5 pavement (including the northbound off-ramp) at approximately equal intervals. Shovel test pits will be manually excavated. Excavated soils will be screened through 1/8th inch mesh to optimize artifact recovery. Shovel test pits will be mapped onto 1 :I 00 scale project base maps using tapes and compasses. Shovel test pits will measure approximately 30 centimeters by 30 centimeters and will be excavated to sterile soil or to a depth of 50 centimeters, whichever comes first. Recovered artifacts will be cleaned and cataloged. Temporary curation will be provided until an appropriate permanent curation facility can be identified. The ASR will include the results of the Extended Phase I investigations at both sites. The preliminary draft ASR will be submitted to the City for review and will be accompanied by recommendations as to whether a Phase I1 investigation is needed. The draft ASR will incorporate the City’s comments and will be submitted to Caltrans. Following receipt of Caltrans’ comments, the final ASR will be prepared responding to those comments. Task 3: Staking of Sensitive Area Boundary and Survey of Driveway Archaeologists will place twelve, three-foot wooden lathe along the limits of cultural deposits which are to be avoided. Additionally, archaeologists will conduct a survey of the proposed private drive south of La Costa Avenue. The results of these two activities will be included in the final ASR. 2 p 0 e Task 4: Historic Property Survey Report (HPSR) Archaeologists will prepare an HPSR summarizing the previous studies in order to identify the historic properties potentially affected by the project. The HPSR will be positive, indicating that site CA-SDI-603 is eligible but that the project will have no effect on the site. Per Caltrans’ comments on the earlier studies, the Area of Potential Effect (APE) will be revised and project Stages 1 and 2 will be combined. The Scope of Survey will be as follows: 1. Revise ASR and Extended Phase I maps: Caltrans has required that the Stage 1 and Stage 2 project maps be combined and that references to the APE be changed to study area. In response to this requirement, KEA will prepare revised cultural resources survey and excavation maps, utilizing a base map to be provided by Boyle. 2. Include proposed off-site private driveway connecting Parcels 21 6-060-52 and 21 6-060-54 survey in project documentation: The ASR and Extended Phase I reports must be revised to include the driveway survey that was conducted after Caltrans’ review of these reports. These reports will be submitted first to the City of Carlsbad for review and subsequently to Caltrans. Any additional City or Caltrans comments will be addressed. The final reports must also be submitted to the South Coastal Information Center for curation. 3. Prepare draft HPSR: This document summarizes the previous reports. In addition, it contains necessary Section 106 compliance information, including discussions of resource significance and project effect. It is assumed that through redesign, no potentially significant resources will be affected by the project. The HPSR must contain sufficient documentation to support this position. An inadequate HPSR could result in the need to evaluate the two archaeological sites that are adjacent to the HPSR. 4. Prepare final HPSR: The draft report will be sent first to the City of Carlsbad for review. After addressing the City’s comments, KEA will prepare a Caltrans review draft. Prepare 1" = 50' scale layout sheets showing the proposed redesign of the project to avoid the limits of the cultural site CA-SDI-603 (as staked in Task 3 above). B. Prepare Intersection Lane Volume (ILV) and Intersection Capacity Utilization (ICU) calculations to determine the traffic operations of the proposed redesign. C. Attend meetings and coordinate with Caltrans, the City, and the environmental subconsultant to gain approval of the project redesign, to resolve environmental issues and to assist with the environmental clearance process. D. Revise project report plates to reflect the redesign. E. Prepare landscape concepts and attend one meeting with Caltrans and the City. Finalize the landscape concepts and request an approval letter from Caltrans. Update the visual study to reflect the landscape concepts. F. Revise the project report text to reflect the redesign, updated accident data, design exceptions, the revised construction cost estimate, a water usage letter, and landscape concepts. Submit two (2) copies of the draft project report for Caltrans review and one for City review. Meet with Caltrans and the City to discuss comments. Document comments in writing. G. Revise the project report based on City and Caltrans comments. Submit forty (40) copies for Caltrans district circulation and two (2) copies for final City review. Meet with Caltrans and the City to discuss final comments. Document discussions in writing. H. Prepare the final project report, incorporating City and Caltrans comments. Submit fifty (50) copies to Caltrans and three (3) copies to the City. This scope of services does not include any revisions to the project plans and specifications. It is anticipated that a separate amendment will be completed for revisions to the final design.
