RESOLUTION NO. 94-302
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING A QUITCLAIM FOR DRAINAGE EASEMENTS
IN AVIARA PA 24, UNIT 4, CT 90-15-4
WHEREAS, Hillman Properties have submitted a request for quitclaim of some 1
drainage easements within Aviara Planning Area 24, Unit No. 4 (CT 90-15-4); and
WHEREAS, said drainage easements are not currently needed nor are they conteml
to be needed for the purpose for which they were dedicated; and
WHEREAS, the City Council of the City of Carlsbad has determined it to be in the 1
interest to quitclaim a portion of said easement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carl
California, as follows:
1. That the above recitations are true and correct.
2. That the Quitclaim Deed conveying drainage easements over portions of APN':
642-01, 21 5-642-1 1 , 21 5-642-1 2, 21 5-642-1 7, 21 5-642-33 and 21 5-642-34 to Greystone Hc
Inc., A Delaware Corporation, which is on file with the Clty Clerk and is incorporated k
reference; is approved.
3. That the Mayor is authorized to execute the original Quitclaim Deed and the City
is hereby authorized to cause the original Quitclaim Deed to be released to the property 0'
to be recorded in the Office of the County Recorder of San Diego County, State of Califc
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Cl
held on the 25th day of OCTOBER , 1994 by the following vote, to wit:
AYES: Council Members Lewis, Stanton, Nygaard, and Finnila
NOES: None
ABSENT: Council Member Kulchin
