HomeMy WebLinkAbout1994-12-20; City Council; Resolution 94-333I/ 1 2 3 4 0 0 Exhibit 1 RESOLUTION NO. 94-333 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS FOR THE CONSTRUCTION OF THE JEFFERSON STREET BIKE LANES, CITY PROJECT NO. 31 56, FEDERAL PROJECT NO. 1 1 -SD-0-Cbd, STPLE-5308-(001) 5 WHEREAS, the City Council of the City of Carlsbad has determined it nece 6 desirable, and in the public interest to construct the Jefferson Street Bike Lanes; and 7 WHEREAS, plans, specifications, and contract documents for the furnishing of all * 9 materials, tools, equipment, transportation, and other expenses necessary or incidental fc project have been prepared and are on file in the Engineering Department of the C lo Carlsbad; and 11 12 13 14 15 16 WHEREAS, the City Council of the City of Carlsbad has previously appropriated Grant funds and General Reserve funds with remaining balances of $64,000 and $8( respectively, for said project; and WHEREAS, the City has made application for Federal lntermodal Surface Transpon Efficiency Act (ISTEA) funding through Caltrans in the amount of $162,717; and I? ll WHEREAS, State Grant, Federal ISTEA, and General Fund Reserve funds are cur 18 19 and 300-820-1 840-31 56 ($80,000), respectively, for a total of $306,717; and available in Project Account Nos. 380-82081 05-31 56 ($64,000), 392-820-821 1-31 56 ($1 62 20 WHEREAS, as a condition of the Supplemental Agreement No. 17 to the 1 21 23 Department of Transportation is required to either reject or award a contract. 22 Agency-State Master Agreement for Federal Aid Projects, that the concurrence from the Calil WHEREAS, Retaining Walls, Inc., was the lowest responsive and responsible bidder i 24 amount of $256,232; and 25 26 27 WHEREAS, construction of said improvements is a matter of public necessity and si and 28 * ll * 0 L 1 WHEREAS, Wier Construction has protested the award to Retaining Walls, Inc., 2 I( on alleged bid irregularities. 3 4 California, as follows: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Car 5 2. That the protest of Wier Construction is hereby denied based on Retaining 1 Inc., clarification letter dated, November 22, 1994 removing any bid qualifications impactir: responsiveness of the bid. 15 16 17 6.
