That certain agreement between the City of Carlsbad and the Palomar Community 5 The City Council of the City of Carlsbad, California does hereby resolve as follows: 6 District for paramedic training, attached hereto as Exhibit A, is hereby approved. 7 2. RAUTEN 23 (SEAL) (I 24 25 26 27 28 ll 0 e' AGREEMENT THIS 'AGREEMENT made and entered into this 7th day February, 1995 by and between the Governing Board of Palom Community College, hereinafter called the COLLEGE, and City Carlsbad Fire Department, hereinafter called the EMT-P SERVI PROVIDER, do hereby agree as follows: BASIS AND PURPOSE OF THE AGREEMENT WITNESSETH: WHEREAS, the COLLEGE is hereby authorized to enter into th agreement as permitted by California Education Code Section 7824 WHEREAS, the COLLEGE and EMT-P SERVICE PROVIDER acknowledge public obligation-to c0ntribut.e to the education of paramedics f the benefit of the students and for community needs, WHEREAS,. the COLLEGE has established a program for traini paramedics that requires the educational facilities of the EM? SERVICE PROVIDER in field practice, WHEREAS, the EMT-P SERVICE PROVIDER has field faciliti suitable for the educational needs of the COLLEGE paramec program, WHEREAS, it is to the mutual benefit of both the COLLEGE E EMT-P SERVICE PROVIDER that students have opportunities for fie service education as students and future practitioners. NOW, THEREFORE, the COLLEGE and the EMT-P SERVICE PROVII mutually agree as follows: I. RESPONSIBILITIES AND PRIVILEGES OF THE COLLEGE A. For the Prosram in General 1. The COLLEGE assumes full responsibility j offering an educational program eligible j . accreditation by the State Department of Educat: and the San Diego County Division of Emerge] Medical Services. 2. The COLLEGE will provide the same quality education in the paramedic program as it does all other curriculum offerings at the COLLEGE. 3. The word l1faculty1! as used herein means the COLLl faculty engaged in teaching in the COLLl Paramedic Program. The words "student It llstudentsll as used herein means students of : COLLEGE who are enrolled in the COLLEGE Paramec Program. 1 a 0’ 4. The COLLEGE will select and train preceptors cooperation with the field service providers. 3. Clinical Instructions 1. The COLLEGE will provide the necessary faculty plan and coordinate the field experience f paramedic students. Said faculty will assu responsibility for monitoring EMT-P students whi assigned to the EMT-P SERVICE PROVIDER. 2. The COLLEGE will develop a plan for using the EMT SERVICE PROVIDER’S facilities to meet t educational goals of the curriculum. This pl will include a list of the number of hours involl ‘and shall be made available to the EMT-P SERVl PROVIDER at a mutually agreed upon time prior the beginning .of the school term and subject revision by the EMT-P SERVICE PROVIDER in instanc where conflicts with the EMT-P SERVICE PROVII seem to exist. 3. The COLLEGE will assume responsibility f determining the final grade evaluation relative the students performance after consultation wj students file preceptor. 4. The faculty will be responsible for learning : observing the policies and regulations of bl COLLEGE and EMT-P SERVICE PROVIDER as they apply the circumstances of the field.teaching. 5. The COLLEGE is responsible to assure the stude, assigned to the EMT-P SERVICE PROVIDER for fi internship meet both COLLEGE and EMT-P SERV PROVIDER standards of health and have the acade ability to profit from the experience. 6. The COLLEGE will require that all instructors students during assignment to the EMT-P SERV PROVIDER comply with the same administrat policies as the employees in matters relating the welfare of the patient. C. COLLEGE Privileqes 1. The COLLEGE has the privilege of regula scheduled meetings with the EMT-P SERVICE PROVI staff and administrative level representatives the purpose of interpreting, discussing, evaluating this educational program for trair . paramedics. 2 0 0 11. RESPONSIBILITIES AND PRIVILEGES OF THE ljT-TI"P SERVICE PROVIDI A. General Responsibilities 1. The EMT-P SERVICE PROVIDER will maintain tl standards which made it eligible for approval as field area for instruction in an accreditt paramedic program provided, however, the EMT, SERVICE PROVIDER shall not be obligated 1 establish,. maintain or continue any facilities ( 'services .that the EMT-P SERVICE PROVIDER, in ii sole discretion, does not wish to establisl maintain or continue. 2. The EMT-P SERVICE-PROVIDER will permit the facul. and students of the COLLEGE to use its patient ca and patient service facilities for field educatii in- accordance with policies, procedures a] protocols of the San Diego County Division ( Emergency Medical Services. 3. The EMT-P SERVICE PROVIDER will accept for fie: internship emt-p students in a number mutual: agreed upon by the COLLEGE and EMT-P SERVI( PROVIDER. B. Facilities and Supplies 1. The EMT-P SERVICE PROVIDER will permit t educational use of such supplies and equipment are commonly available for patient care. 2. The EMT-P SERVICE PROVIDER will provide access sources of information for educational purpose subject to the EMT-P SERVICE PROVIDER'S right protect the privacy of the patient: a. Procedures guides, policy manuals b. Standard field references such as medic, dictionary, diagnostic texts, pharmacolo' references and standard references suitable the field area and care program. Examples: C. Staff Participation in Education 1. The EMT-P SERVICE PROVIDER will recommend staff function as preceptors for paramedic studen during the field internship. The ratio preceptors to students shall not exceed one to on 2. Preceptors will attend a training session for t purpose of orienting them to the education program and evaluation procedures. 3 0 0 3. Preceptors will assist with the education an evaluation of paramedic students during the fie1 internship. 4. Preceptors will remain employees of the EMT- SERVICE PROVIDER and will 'not be considere employees of the COLLEGE. D. EMT-P'SERVICE PROVIDER Privileqes 1. The EMT-P. SERVICE PROVIDER may refuse education; access to its field areas or records to any COLLEC faculty or students who do not meet the EMT- SERVICE PROVIDER'S standards. 2. The EMT-P SERVICE PROVIDER may resolve any problc situation in favor of the patient's welfare and m; restrict the student involved. E. Status of Students 1. Students will have the status of learners and wil not replace EMT-P SERVICE PROVIDER staff, nor gix service to patients apart from its educationE value. 2. Students are subject to the authority, policies ar regulations of the COLLEGE. They are also subject during field assignment and while with the EMT- SERVICE PROVIDER, to the authority, policies ar regulations of the EMT-P SERVICE PROVIDER. 3. Students will wear the designated uniform in fie: areas. F. Liability Status of Contractinq Aqencies 1. The COLLEGE shall carry professional liabilil insurance .(malpractice) covering students of tk COLLEGE during assignment with EMT-P SERVI( PROVIDER. 2. The COLLEGE shall carry public liability insuranc covering faculty members of the COLLEGE durir assignment with the EMT-P SERVICE PROVIDER. 3. The COLLEGE shall carry workers' compensatic insurance covering its faculty and students whi: with the EMT-P SERVICE PROVIDER (pursuant to Lab( Code Section 3368). .. 4. COLLEGE shall indemnify and hold harmless EMT SERVICE PROVIDER from and against any and a: liability arising from any negligent act, of 4 I e e' 1 COLLEGE'S students or instructors during the field internship. 5. EMT-P SERVICE PROVIDER shall indemnify and hold' harmless COLLEGE from and against any and all liability arising from any negligent act of EMT-P SERVICE PROVIDER, its officers,' agents or employees. G. Duration of the. Contract 1. This agreement shall be effective on January 23, 1995 and shall terminate June 30, 1998, unless terminated earlier for cause by either party with thirty days prior .written notice of the intention to do so. Under no circumstances shall this contract exceed.three Program Years. 2. If problems arise during the tenure of this agreement, the respective parties shall by mutual consent, review the content and if necessary, revise the contract as deemed appropriate.
