A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A MASTER PLAN TEXT
AMENDMENT (MP 177(J)) TO ALLOW HOMES UP TO 30 FEET
IN HEIGHT IN AVlARA PLANNING AREA 28, WITHIN PHASE II
OF THE AVlARA MASTER PLAN.

WHEREAS, the Planning Commission did on January 4, 1995, hold i
noticed public hearing as prescribed by law to consider an amendment to the 1
Master Plan (MP-l77(J)); and
WHEREAS, the City Council of the City of Carlsbad, on the 7th~
March , 1995, held a duly advertised public hearing to consider said amenc
and at that time received the recommendations, objections, protests, comments
persons interested in or opposed to MP-l77(J); and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council
City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the revised text for the Aviara Master Plan (MP 177(J)) is apF
according to Exhibit "Z, dated January 4, 1995, attached to Planning Comm
Resolution No. 3674 and hereby incorporated by reference, and that the finding
conditions of the Planning Commission as set forth in Planning Commission Resc
No. 3674, on file in the Planning Department and made a part hereof by referen1
the findings and conditions of the City Council, with the exception that finding nl
4 of Planning Commission Resolution No. 3674 is replaced with the following fil
"(1) All requirements of the California Environmental Quality Act have bec
through the Certified Environmental Impact Report for the Aviara Master Plan (E
02(A)). All feasible mitigation identified in EIR 83-02(A) will be undertaken in this F
as designed and constructed."
