RESOLUTION NO. 95-167 - EX1
A RESOLUTION OF THE CITY COUNCIL OF THE CIT’
OF CARLSBAD, CALIFORNIA, APPROVING THE 1995, FISCAL YEAR CAPITAL IMPROVEMENT BUDGET OF THE WASTEWATER AUTHORITY
WHEREAS, the City of Carlsbad is a member agency to the
Joint Powers Basic Agreement entered into on June 13, 1961,
acquisition, construction, ownership, operation and mainten
the Encina Joint Sewer System; and
WHEREAS, the Encina Basic Agreement requires approval
budget of the Encina Wastewater Authority (EWA) by the
agencies following the recommendation of the Joint AI
Committee (JAC) : and
WHEREAS, the City Council of the City of Carlsbad des
approve said budget and provide for payment of its share 1
expenses in accordance with the allocation provided in thi
Agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of t
of Carlsbad as follows:
Section 1: That the Fiscal Year 1995/96 capital budget
EWA, as approved by the JAC on May 24, 1995 in the amount
Hundred Fifty-Six Thousand, Four Hundred Dollars ($656,1
hereby approved.
Section 2: That the City of Carlsbad‘s share of .
1995/96 fiscal year Capital Improvement Program budget
Hundred Thirty-Seven Thousand, Sixty-Eight Dollars ($137,0
Section 3: The City Manager is hereby authorized
payments on behalf of this agency to the EWA in accordance u
budget approved by JAC and in accordance with the Encin,
Agreement.

Section 4: This resolution shall be forwarded to
immediately upon its execution.
PASSED, APPROVED AND ADOPTED at a regular meeting
Carlsbad City Council held on the 20th day of JUb
