RESOLUTION NO. 95-210
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING A
TENTATIVE TRACT MAP AND PLANNED UNIT
DEVELOPMENT FOR A 65 LOT SUBDIVISION
CONSISTING OF ONE PRIVATE STREET LOT, ONE
SEWER PUMP STATION LOT, TWO OPEN SPACE LOTS
AND 61 RESIDENTIAL LOTS TO ACCOMMODATE 61
DETACHED SINGLE FAMILY HOMES ON 5,000
SQUARE FOOT MINIMUM SIZED LOTS WITHIN
MASTER PLAN LOCATED NORTH OF BATIQUITOS
LAGOON, IN THE COASTAL ZONE IN LOCAL
FACILITIES MANAGEMENT ZONE 9.

WHEREAS, pursuant to the provisions of the Municipal Code, the Plz

19 objections, protests, comments of all persons interested in or opposed to CT 94-07

21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the City C

1. That the above recitations are true and correct.
2. That the City Council APPROVES City Council Resolution r\

Planning Commission Resolution Nos. 3771 and 3772, on file in the Planning 27
210, and that the findings and conditions of the Planning Commission as set fc

City Council, except as modified by No. 3 below. 2
Department and made a part hereof by reference are the findings and conditions
3 3. Planning Commission Resolution No. 3771, Condition No. 13(
4 page 7 shall read as follows: The Developer shall establish a homeowner’s associatic

corresponding covenants, conditions and restrictions. Said CC&Rs shall be submit 6
7 and approved by the Planning Director prior to final map approval. The CC&Rs
8 incorporate the following items:
