A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING THE
REVISED ENCINA AUTHORIZATION AGREEMENT FOR
LAND ACQUISITION
WHEREAS, the City of Carlsbad is a member agency to the Encina Joint Powers

ownership, operation and maintenance of the Encina Joint Sewer System; and 8
Agreement entered into on July 13, 1961, for the acquisition, for the acquisition, construction,
9 WHEREAS, the Encina Agreement requires approval for budget amendments of the
lo 11 Encina Wastewater Authority (EWA) by the Member Agencies following the recommendation

12 of the Joint Advisory Committee (JAC); and
13 il WHEREAS, the Encina Wastewater Authority (EWA) and the Encina Joint Advisory

WHEREAS, Encina Planning studies have identified possible needs for additional land for 16
behalf of the Member Agencies; and 15
Committee (JAC) have recommended the City of Carlsbad be authorized to acquire land on
l7 I/ flow equalization, and administrative facilities as well as a buffer zone; and

19 11 WHEREAS, the Encina wastewater Authority (EWA) will provide a portion of the land
20
21 future agreement;
to be made available to any Encina member agency for a water reclamation facility subject to
22 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad
23 11 as follows:

1. That the Agreement dated June 28, 1995, authorizing the Encina Wastewater Authority
to acquire land on behalf of the Encina Member Agencies be approved.

2. That the City Manager be authorized to execute a letter agreement with tl

3. This resolution shall be forwarded to the EWA immediately upon its exec1
