A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD
CALIFORNIA, CONFIRMING THE REPORT OF THE FIRE CHIEF SHOWIN
COST OF WEED ABATEMENT AGAINST EACH PARCEL OF LAND IN SA1
REPORT, CONFIRMING THE COST, AND PROVIDING FOR COLLECTION
QN THE REGULAR TAX BlLl
WHEREAS, on April 04, 1995 this City Council adopted

Resolution No. 95-82 pursuant to Government Code Sections, 3950
11
through Section 39588 declaring weeds, rubbish, and refuse on the
real property described therein to be a public nuisance; and
12 WHEREAS, pursuant to said resolution, a hearing was held by

said City Council, and thereafter said City Council adopted
15
Resolution No. 95-97 directing the Fire Chief to abate the nuisance
l6 j/ by removal of the weeds, rubbish, and refuse on the real property
17

described in said resolution; and
19
WHEREAS, California State Government Code Section 39560,
2o 11 et. seq., requires that a report of the cost of such abatement be
21

following a public hearing, and the Fire Chief has kept the required 22
submitted to the City Council for consideration and confirmation
WHEREAS, said work has been duly performed in accordance, 26
25
accounts and has submitted his report to the Council for
confirmation; and

1 manner and form required by law; and
2 WHEREAS, at the appropriate time and place said report was

respect to any matter relating to said abatement work; and 7
Council gave all persons present an opportunity to be heard in
received and considered for confirmation by this City Council, at
which time all protests and objections were heard, and this City
8 jl WHEREAS, all persons desiring to be heard have been heard by

10 this City Council.
11 NOW, THEREFORE, BE IT RESOLVED by the City Council of
I.2 the City of Carlsbad as follows:

14 1. That the above recitations are true and correct.
15 j! 2. That the abatement work, the report submitted to this
16 Council, and the posting of the Notice of Time and Hearing on said II
l7 11 report were duly and regularly performed in the manner and time
l8 I!
19 )I ' required by law.

20 3. That all protests and objections, other than those
21

heretofore allowed and deleted from said report, if any, were and
23 Ii are hereby overruled and denied.
24 4. That said report, a copy of which is on file in the office
25 the City Clerk, and by this reference made a part hereof, is hereby
26

confirmed, and each of the amounts set forth therein are hereby

and shall constitute a special assessment and a lien against such 2
assessed against the parcel of real property shown with said sum
parcel of land.
5 I1 5. The City Clerk is hereby directed to forward a certified

copy of this .resolution, together with a copy of said report to the
office of the San Diego County Auditor on or before August 10, 199:
