CITY COUNCIL RESOLUTION NO. 95-249
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA TO APPROVE AN
AFFORDABLE HOUSING MITIGATION AGREEMENT
BETWEEN THE CITY OF CARLSBAD AND KAIZA
POINSETTIA CORPORATION
WHEREAS, Kaka Poinsettia Corporation has a requirement to providl
housing units affordable to lower income households within the southwes
quadrant of the City; and,
WHEREAS, Kaka Poinsettia Corporation has expressed a desire tc
financially participate in a Combined Inclusionary Housing Project known as th(
Laurel Tree Apartment Project to satisfy the requirement to provide housini
affordable to lower income households; and,
WHEREAS, the Laurel Tree Apartment Project satisfies the City o
Carlsbad’s identified criteria for an acceptable Combined Inclusionary Housinl
Project.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Cit!
Council of the City of Carlsbad, California, as follows:
1. The above recitations are true and correct.

2. That the City Council hereby approves the Affordable Housi
Mitigation Agreement, in substantially the form presented, betwe
the City of Carlsbad and Kaiza Poinsettia Corporation which u
allow Kaiza Poinsettia Corporation to financially participate in 1
construction of housing units affordable to lower incol
households in an off-site Combined Inclusionary Housing Projc
known as the Laurel Tree Apartments.
3. That the City Council hereby authorizes the City Manager, or :
designee, to execute said agreement in substantially the fo
presented and with such modifications as City Attorney dee
necessary and appropriate.
PASSED, APPROVED, AND ADOPTED at a regular meeting of 1
City Council of the City of Carlsbad, California, held on the 12th day
SEPTEMBER , 1995, by the following vote, to wit:
