2 ll A RESOLUTION OF THE CITY COUNCIL OF THE
3 CITY OF CARLSBAD, CALIFORNIA TO APPROVE AN
AFFORDABLE HOUSING MITIGATION AGREEMENT I
BETWEEN THE CITY OF CARLSBAD AND
BRAMALEA CALIFORNIA INC .

WHEREAS, Bramalea California Inc. has a requirement to provid
housing units affordable to lower income households within the southwe!

WHEREAS, Bramalea California Inc. has expressed a desire 10
quadrant of the City; and,
financially participate in a Combined Inclusionary Housing Project known as tl 11

Laurel Tree Apartment Project to satisfy the requirement to provide housir
affordable to lower income households; and,
WHEREAS, the Laurel Tree Apartment Project satisfies the City

17 Project.
Carlsbad’s identified criteria for an acceptable Combined Inclusionary Housi

19 NOW, THEREFORE, BE IT HEREBY RESOLVED by the C

Council of the City of Carlsbad, California, as follows:
1. The above recitations are true and correct. 22

2. That the City Council hereby approves the Affordable Housin
Mitigation Agreement, in substantially the form presented, betwee
the City of Carlsbad and Bramalea California Inc. which will all01
Bramalea California Inc. to financially participate in th
construction of housing units affordable to lower incom
households in an off-site Combined Inclusionary Housing Projec
known as the Laurel Tree Apartments.
3. That the City Council hereby authorizes the City Manager, or hj
designee, to execute said agreement in substantially the forr
presented and with such modifications as City Attorney deer
necessary and appropriate.
PASSED, APPROVED, AND ADOPTED at a regular meeting of th
City Council of the City of Carlsbad, California, held on the 12th day (
SEPTEMBER , 1995, by the following Vote, t0 Wit:
