RESOLUTION NO. 95-320
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A SECOND BUDGET
AMENDMENTTO THE ENCINA WASTEWATER AUTHORITY FY
OF ADDITIONAL FUNDS, AND AUTHORIZING THE EXECUTION
OF THE PURCHASE AND SALE AGREEMENT FOR THE
ENCINA WATER POLLUTION CONTROL FACILITY
1995-96 CAPITAL IMPROVEMENT PROGRAM, APPROPRIATION
ACQUISITION OF THE 37-ACRE PARCEL ADJACENT TO THE
7 /I WHEREAS, the City of Carlsbad is a member agency to the Encina Joint

Agreement entered into on July 13, 1961, for the acquisition, construction, ownership, o
and maintenance of the Encina Joint Sewer System; and
WHEREAS, the Encina Agreement requires approval for budget amendmeni
Encina Wastewater Authority (EWA) by the Member Agencies following the recommend
the Joint Advisory Committee (JAC); and
WHEREAS, the Encina Wastewater Authority (MA) and the Encina Joint
Committee (JAC) have recommended the City of Carlsbad be authorized to acquire
behalf of the member agencies; and

2. Funds are available in the Sanitation Enterprise Fund Account Number 51 1 -I
2494.
3. The City’s share of $1,113,090 for the purchase of the parcel is available fro1
excess capital funds on account with the RNA plus the additional $3,092 appro
