HomeMy WebLinkAbout1995-12-05; City Council; Resolution 95-333-, 0 e 1 2 3 4 RESOLUTION NO. 95-333 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAI CALIFORNIA, APPROVING THE APPLICATION FOR FUNDS FOR THE FEDEW TRANSPORTATION ENHANCEMENT ACTIVITIES (TEA) PROGRAM UNDER Tt- INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991, 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the United States Congress has enacted the lntermodal Transportation Efficiency Act of 1991, which is to make available over $200 million dollars over a six-year period as funds to the California Department of Transpor transportation enhancement activities; and WHEREAS, the Department of Transportation has established the procedures a1 for reviewing proposals and, along with the Regional Transportation Agencies, will sub California Transportation Commission a list of recommended projects from which the will be selected; and WHEREAS, said procedures and criteria established by the California Depa Transportation call for the approval of an application by the applicants governing bo submission of said application to the California Department of Transportation; and WHEREAS, the application contains assurances that the applicant must comply WHEREAS, the applicant, if selected, will enter into an agreement with thc California to carry out the transportation enhancement activities project; and WHEREAS, the City Council of the City of Carlsbad, California has deterr necessity and desirability to apply for federal funding for Palomar Airport Road115 In Enhancement, the Coastal Rail Trail, and Buena Vista Lagoon Boardwalk. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of California, as follows: 1. That the above recitations are true and correct. 2. That the City Council approves the filing of an application for the Tran Enhancement Activities Program for consideration for funding on the above named 1 I Ill '4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 l e a 3. That the City of Carlsbad will provide a minimum of 12 percent match, or in non-federal funds as required under the TEA program. Upon approval, General Fun will be appropriated for the 12 percent match. 4. That the City Council will make adequate provisions for operation and mair of the project. 5. That the City Engineer or designee is hereby appointed as agent of thc Carlsbad to conduct all negotiations, execute and submit all documents including, but nc to, application, agreements, amendments and payment requests which may be necessa completion of the aforementioned project. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad Crty held on the 5th day of DECEMBER , 1995 by the following vote, to wit: AYES: Council Members Lewis, Mygaard, Finnila, Hall NOES: None ABSENT: Council Member Kulchin ATTEST: Clerk (SEAL)
