RESOLUTION NO. 96 -20
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AF'PROVINGA MASTER
PLAN AMENDMENT, LOCAL COASTAL PROGRAM
AMENDMENT, TENTATIVE TRACT MAP REVISION
AND PLANNED UNIT DEVELOPMENT PERMIT AMENDMENT WITHIN PLANNING AREA 12 OF THE
AVIARA MASTER PLAN GENERALLY LOCATED IN
THE SOUTHWEST QUADRANT IN LOCAL FACILITIES
MANAGEMENT ZONE 19.

WHEREAS, pursuant to the provisions of the Municipal Code
Planning Commission did, on November 15, 1995, hold a duly noticed public hearii
prescribed by law to consider a Master Plan Amendment, Local Coastal Pro!
Amendment, Tentative Tract Map Revision and Planned Unit Development PC
Amendment; and
WHEREAS, the City Council of the City of Carlsbad, on the 16th
of January , 1996, held a duly advertised public hearing to consider said M
Plan Amendment, Local Coastal Program Amendment, Tentative Tract Map Revisior
Planned Unit Development Permit Amendment and at that time received
recommendations, objections, protests, comments of all persons interested in or opp
to MP 177(L)/LCPA 95-13/CT 89-39(A)/PUD 89-19(A); and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Co
of the City of Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the City Council APPROVES City Council Resolution Nc
, and that the findings and conditions of the Planning Commission i
forth in Planning Commission Resolution Nos. 3840, 3841, 3842 and 3843 on file wit

City Clerk and made a part hereof by reference are the findings and conditions of the
Council.
3. That the application for Master Plan Amendment (MP 177(L'
allow revisions to the permitted uses and development standards on property gene

revisions to the permitted uses and development standards on property generally loc
south of Alga Road, between Black Rail Court and Blue Heron Drive in Aviara Plan
Areas 12, in LFMP Zone 19 is approved as shown in Planning Commission Resolution
3841 on file with the City Clerk and incorporated herein by reference.

6. That the Tentative Subdivision Map Revision (CI' 89-39(A)) to a
a 101 unit clustered single family condominium development on property generally loc
south of Alga Road, between Black Rail Court and Blue Heron Drive in Aviara Plan
Area 12, in LFMP Zone 19 is approved as shown in Planning Commission Resolution
3842 on file with the City Clerk and incorporated herein by reference.
7. That the Major Planned Unit Development Permit Amendment (E
89-19(A)) to allow a 101 unit clustered single family condominium developmen
property generally located south of Alga Road, between Black Rail Court and Blue Hc
Drive in Aviara Planning Area 12, in LFMP Zone 19 is approved as shown in Plan
Commission Resolution No. 3843 on file with the City Clerk and incorporated herei
reference.
